November 11, 2009 - Arnold & Itkin LLP announces lawsuits over defective pain pumps The Houston trial law firm Arnold & Itkin LLP has filed five lawsuits against the makers of defective pain pumps and related medications based on claims that many of the company’s defective medical devices are causing irreversible shoulder damage among patients. Currently, medical injury attorneys at Arnold & Itkin LLP represent 28 people who received pain pumps to manage pain following shoulder surgery. The pumps utilize a catheter to deliver continuous doses of medication directly into the shoulder. According to the lawsuits, pain pump manufacturers were denied approval by the U.S. Food and Drug Administration to use the pumps to mitigate pain in shoulder joints, but the companies continued to promote their use in that way. Many former pain pump users say the companies were negligent in designing, researching and selling pain pumps that they should have known were dangerous. The legal filings include claims of fraud, breach of warranty and products liability against the defendant manufacturers. October 16, 2009 - National publication highlights Arnold & Itkin's Hurricane Ike work When covering the one-year anniversary of Hurricane Ike The National Law Journal turned to Houston trial lawyer Kurt Arnold to discuss the growing number of lawsuits over denied and underpaid insurance claims related to the storm. In the story published Sept. 25, 2009, "Hundreds of Hurricane Ike-related suits remain pending against insurers," Mr. Arnold details some of the experiences his clients are having when dealing with insurance companies. "I have some claims that had $150,000 in damages, and [the adjuster] wrote up $2,000," Arnold says in the article. Arnold & Itkin represents hundreds of Hurricane Ike victims whose insurance claims have been delayed or denied.
(Excerpts summarized from the Southeast Texas Record, a legal journal based in Beaumont, Texas) Jurors will have to decide whether Patsy Ardoin negligently failed to stay stopped at a railroad crossing or if it was Union Pacific's inadequate safety precautions that caused Ardoin's vehicle to be struck by a train. Ardoin was killed in the train collision, while Ardoin's 4-year-old daughter Jazmine Cezar, a passenger in the vehicle, was thrown from the truck. Jazmine Cezar survived the accident, but spent almost six months in various hospitals and will be confined to a wheelchair the rest of her life. Read the entire article.
Houston Chronicle - Chron.com: Jury awards verdict for Plaintiffs in train wreck lawsuit November 10, 2007 - A Texas jury rendered a verdict for the family of a woman killed when her truck was hit by a train at a Louisiana railroad crossing. The family was represented by Arnold & Itkin LLP attorneys, Kurt Arnold, Jason Itkin and Jeff Seely. The money from the civil lawsuit filed in district court in Jefferson County will help the family care for the woman's young daughter, who was paralyzed from the chest down in the crash.
BeaumontEnterprise.com: Jury awards damages to survivor in train wreck lawsuit November 10, 2007 - A Jefferson County jury returned a verdict in favor of the plaintiffs in the death of a 36-year-old Vinton woman who was killed when her pickup was struck by a Union Pacific train in 2005. Dallas Morning News: Goalie suing mask maker April 17, 2006 - The Dallas Morning News published this story by Michael Grabell about Dallas dentist Dr. Michael Eeds who was severely injured when his hockey masked failed to protect him from a flying hockey puck. Dr. Eeds filed suit against the mask maker to hold them accountable to ensure that more people were not injured by this defective product and to financially compensate him for his injuries.
