Helping People Recover from Life-Altering Injuries

Catastrophic accidents cause life-changing injuries. Legally and medically, catastrophic injuries are injuries that affect a person’s cognition or mobility on a long-term scale; these kinds of injuries can require extensive treatment and costly therapy while rendering survivors unable to earn a living. As a result, catastrophic accident survivors often go deep into debt, making them even more vulnerable to health-related setback in the future.

Our East Texas firm has represented clients with catastrophic injuries like:

  • Brain damage
  • Amputated limbs
  • Neck and back injuries
  • Severe burn injuries
  • Post-traumatic stress
  • Spinal cord injury

Our firm’s duty is to figure out how much an injury will cost our clients; once we’ve done that, we file a claim to ensure our clients can afford medical care, recoup lost wages, and enjoy financial security for their lives. That’s how we’ve been able to change our clients’ lives for the better, either through a trial verdict or with a settlement.

East Texas Boat Accident Lawyers

Many people experience the tragedy of a car accident at some point. Even if they do not personally experience a car accident, nearly every person knows someone who has had their life changed by one. However, most individuals never expect to experience a boat accident. Many people throughout East Texas enjoy boating along the Gulf Coast. Texas also has the largest square mileage of inland bodies of water in the country. Texas’ vast aquatic geography has made boating popular for residents and visitors, but that comes with consequences.

When an accident happens, the fun can abruptly turn to tragedy. Boating accidents may cause catastrophic injuries or wrongful death. If you have experienced a boating accident, our Tyler boat accident attorneys are here to help. Arnold & Itkin has won billions for clients in tragic circumstances. Our dedication to our clients has ensured that they could afford the best medical treatment, replace their lost wages or diminished earning ability, or get in-home care when necessary.

Boat Accident Causes

With the variety of recreational bodies of water, it is not surprising that Texas has the fourth-most boating accidents in the nation. Texas also has the second-highest death rate in boating accidents. In 2016, 53 people lost their lives in Texan waters in 176 total accidents. The 30 percent average fatality rate is even more alarming. Boating accidents happen for a variety of reasons. Boaters and boat rental companies must take every precaution to avoid negligent practices that lead to accidents. These are some of the most common causes of boating accidents in East Texas:

BOATING UNDER THE INFLUENCE (BUI)

Most of the nation’s boating accidents happen because operators have fun irresponsibly while on the water. In fact, 19 percent of the nation’s boating fatalities involved alcohol. The intoxicating effects of alcohol become more severe due to the swaying of the water and heat from the sun.

Like with cars, driving under the influence on the water is likely to result in vessel crash or other type of fatal accident.

INEXPERIENCE

Since they have no braking systems, boats take longer to slow down or stop. When an inexperienced or reckless driver is in control of a boat, they may misjudge the time it takes to stop a boat and cause a collision. In Texas, only those who were born after September 1993 are required to go through training before being able to operate a boat. In 2018, anyone over the age of 25 can operate a boat with no formal training. However, age does not prove competence on the water—in 2016, 1 out of every 3 boat accidents were caused by an operator over the age of 35.

OVERCONFIDENCE

A common cause of boating accidents comes down to misjudging surroundings. Large bodies of waters feel open and hazard-free. As a result, even experienced boat drivers have unwarranted confidence in their ability to operate their vessel at high speeds safely.

BOAT RENTALS

Many Texans own their boats and dedicate the time required to be safe. However, boats are also available to vacationers who may have never operated a vessel on the water before. Often, those who are driving boats for a weekend of fun cause accidents due to their inexperience. Even an experienced and conscientious boat operator can their life ruined by someone who should have never been allowed to rent a boat.

About Tyler, TX

Known as the “Rose Capital of America,” Tyler is one of the largest producers of rose bushes in the world. The city is home to one of the biggest rose gardens in the United States, the Tyler Municipal Rose Garden, a 14-acre complex with more than 38,000 rose bushes. This is the location of the annual Texas Rose Festival, which attracts more than 100,000 visitors every October. Tyler had an estimated population of 105,859 as of 2020 and is the largest city in and seat of Smith County. It was named after John Tyler, the 10th President of the United States.

The site that would become Tyler, Texas was first platted in 1847. The town site encompassed 28 blocks within a 100-acre tract. In the town’s early years, its economy was primarily based on agriculture. Logging, metalworking, and leather tanning were other early industries. By the end of the 1800s, fruit orchards (primarily peach trees) and cotton were the dominant crops in the area, but a disease struck the peach trees and farmers began moving toward roses in the 1920s. By the 1940s, most of the nation’s roses were grown in and around Tyler.

Rose growing continues to dominate the Tyler economy, but the city has a strong manufacturing sector as well. Tyler Pipe produces pipe products, Trane Technologies manufactures heat pumps and air conditioners, Delek Refining is an oil refinery in the city, and PCSFerguson manufactures equipment for the natural gas industry. The top employers in Tyler are Trinity Mother Frances Health System, UT Health-Tyler, Brookshire Grocery Company, Tyler Independent School District, and Trane Technologies.

Tyler has a lot to offer residents and visitors, particularly those interested in spending time outdoors. Tyler State Park, located just a few miles north of the city, offers canoeing, camping, paddle boarding, fishing, birding, and more. Tyler is home to golf courses and country clubs, museums, Caldwell Zoo, and the Azalea and Spring Flower Trail, which includes two routes showcasing properties landscaped with azalea shrubs. The Azalea Belles, young women from the Tyler area, are selected each year as the official greeters of the Azalea Trail in March and April.

Common Questions

  • What Types of Compensation Can I Recover?

You may be entitled to economic and non-economic damages in a personal injury lawsuit. Economic damages may cover financial losses related to medical bills, ongoing treatment, lost earnings, and loss of future wages. Non-economic damages may include pain and suffering, emotional trauma, loss of enjoyment of life, and similar injuries. Recovering a fair settlement or award can help you begin to rebuild and move on with your life.
  • How Can a Tyler Personal Injury Lawyer Help Me?

An attorney can help by handling every part of your case so you don't have to. That includes talking to the insurance company and other important parties, investigating to find what caused your accident, filing a case on your behalf, determining the fair value of your claim, negotiating with the at-fault parties to seek a fair settlement, and even taking your case to court if needed to seek a favorable result. While you focus on healing and spending time with loved ones, your Tyler personal injury lawyer can take care of everything else.
  • The Insurance Company Offered a Settlement. Should I Take It?

It's important not to sign a statement or accept a settlement until you've had your attorney look it over. Insurance companies are notorious for offering low settlements that do not cover the full extent of a person's losses and expenses. It's also far too easy to sign paperwork that limits your ability to recover compensation or that even places part or all of the blame for the accident on your shoulders. Work closely with your lawyer to make sure you are not taken advantage of or tricked in any way.
  • Do I Have to Go to the Company Doctor After a Work Injury?

If you were injured at work, your employer may want you to see a certain doctor. If you see that doctor and are not satisfied with the care you received, however, you have the right to request to see a different medical professional. Because every case is different, we recommend that you talk to your attorney about your rights and options.
  • What Will It Cost to Hire a Tyler Injury Attorney at Your Firm?

Our Tyler, TX personal injury firm handles cases on contingency. We do not charge upfront costs and will not get paid for any of our legal services unless we win the case. Only when we've recovered a settlement or award on a client's behalf do we recover our fees. There's no risk to our clients.
