Because his employer did not have an adequate crew on board, our client had to unload heavy pieces of cargo by himself. His employer had a duty to ensure the vessel was seaworthy and ensure that the vessel was adequately equipped with personnel to perform all duties onboard. In this instance, and as we see with many other maritime employers, the company failed tremendously in this regard.
Because of the defendant’s failure, our client is suffering from severe injuries that lower his quality of life. He is scheduled to undergo a complete shoulder replacement next month, and he continues to have pain that radiates throughout his neck and upper back. These injuries make it difficult for him to enjoy moving around, much less make a living.
