On June 8, 2012, Kylie and her family were swimming in the City of Angleton's Natatorium pool. Video evidence shows Kylie was underwater for over 7 minutes before a lifeguard reacted. In fact, another young girl spotted Kylie floating face down in the pool and called for help, but the lifeguard on duty took another minute to even get into the pool. After being pulled from the pool, first responders attempted to resuscitate Kylie. She was rushed to the hospital. She died 7 days later when her mother had to make the agonizing decision to take her off a ventilator.
Kylie is survived by her mother Tabitha Henry, her sisters Hannah Henry and Ashley Henry, and her brother Zachary Henry. The family hopes that this lawsuit will bring change to the policies and procedures at the Angleton Natatorium such as having an appropriate number of lifeguards, properly trained lifeguards, and better supervision for these lifeguards who typically range in age from 16-18.
