Hazmat Transportation is Different
Every commercial truck crash carries serious consequences. A crash involving hazardous materials can compound those consequences in ways that ordinary truck crashes do not. For instance, chemical fires cannot be approached without specialized equipment, chemical releases injure first responders who arrive without knowledge of the cargo, and chemical contamination can close highways for days with public health consequences extending far beyond the crash site.
According to Federal Motor Carrier Safety Administration (FMCSA) crash data, hazardous materials (HM) cargo was present on 3 percent of large trucks involved in fatal crashes and 2 percent of large trucks involved in injury and towaway crashes.1 Of those, HM was released from 30 percent of placarded trucks. Flammable liquids accounted for 64 percent of HM releases resulting in fatal crashes and 50 percent in injury and towaway crashes.2
The federal regulatory framework governing hazardous materials transportation has two separate pillars: (1) the hazmat endorsement, which establishes that a driver is qualified and cleared to transport dangerous cargo;3 and (2) the placard system, which tells everyone at a crash scene what that cargo is.4 When either requirement is not met, the chance of catastrophic error increases.
Hazmat Endorsement
A standard commercial driver’s license does not authorize a driver to haul hazardous materials that require placards. Hazmat endorsements are obtained through a more rigorous process that involves federal security screening, formal training, and a knowledge examination.
"The Hazardous Materials Endorsement Threat Assessment Program conducts a threat assessment for any driver seeking to obtain, renew, or transfer a hazardous materials endorsement on a state-issued commercial driver’s license."5 A driver must apply if they "have a state-issued CDL and are required to transport materials that require placarding under DOT hazardous materials regulations."5 The threat assessment is conducted under 49 C.F.R. Part 1572, enacted pursuant to the USA PATRIOT Act, and includes fingerprint-based biometric screening run by TSA.6
The security screening process is specifically designed to bar drivers with disqualifying criminal histories from operating as hazmat carriers. The TSA background check screens for specific criminal convictions.7 Some offenses are permanently disqualifying. Others are interim disqualifying, meaning they block the endorsement only if the conviction occurred within seven years of the application or the applicant was released from incarceration within five years.8 The list of permanently disqualifying offenses includes espionage, terrorism, and other related crimes reflecting the specific security risk that misuse of hazardous cargo poses.
Beyond the security screening, drivers must complete federally standardized training and pass a knowledge test. Under 49 C.F.R. § 383.93(b), a knowledge test is required for anyone who wishes to receive a hazmat endorsement. The knowledge test can only be taken after the TSA assessment has been completed and the applicant has been cleared for issuance of the endorsement.9 Effective February 2022, any individual seeking a hazardous materials endorsement for the first time must complete the required Entry-Level Driver Training (ELDT) curriculum from a training provider registered with FMCSA before being eligible to take the hazardous materials endorsement knowledge test.10
The endorsement must be renewed every five years and requires a new TSA security threat assessment and, depending on the state, a repeat of the knowledge test.11 A driver whose endorsement has lapsed cannot lawfully transport placarded hazardous materials. A carrier that dispatches such a driver has violated both the endorsement requirement and its independent obligation to ensure driver qualification.12
The Placard System
Placards are the visual communication system that the federal hazardous materials regulatory framework uses to tell emergency responders, the public, and other carriers what is inside a truck. They are standardized by federal regulation, required to be visible from all four sides of the vehicle, and specified by hazard class.13
Under 49 C.F.R. § 172.504, each bulk packaging, freight container, unit load device, transport vehicle, or rail car containing any quantity of a hazardous material must be placarded on each side and each end with the type of placards specified in the regulation’s tables and in accordance with other placarding requirements.14
The regulation organizes hazardous materials into two tables that determine when placards are required:15
Table 1 covers the highest-risk hazard classes, including certain explosives, toxic gases, materials that are dangerous when wet, and radioactive materials. Even a small amount of these hazardous materials creates a significant hazard. Table 2 covers materials whose risk profile is significant, but where quantity thresholds are used to calibrate the burden of the placarding requirement.16
Each hazard class has a designated placard with a standardized diamond shape, color coding, and symbol that communicates the nature of the hazard at a glance:
- A “FLAMMABLE” placard on a tanker tells a firefighter approaching the scene what suppression methods apply and what distances to maintain. The placard must contain a red background with white text and a flame symbol, which is the internationally recognized signal for fire suppression protocols and safe approach distances.17
- A “POISON INHALATION HAZARD” placard tells first responders they may be approaching a scene with an invisible airborne threat that requires respiratory protection before they get close. Importantly, the presence of this placard at the crash scene automatically triggers immediate respiratory protection requirements under OSHA’s hazardous materials response standards.18
- A “DANGEROUS WHEN WET” placard tells emergency personnel not to apply water to a spill.19
These placards serve as operational safety communications for people who will make life-or-death decisions about how to respond. Missing, damaged, or incorrect placards are among the top out-of-service violations for hazmat carriers. "Incorrect placarding creates confusion for first responders and can delay emergency action during an accident."20
Effect of Not Meeting the Federal Requirements
A driver hauling placarded hazardous materials without a current, valid hazmat endorsement has committed a federal regulatory violation under 49 C.F.R. § 383.93. A carrier that dispatched that driver without verifying the endorsement has independently violated FMCSA regulations governing driver qualification under 49 C.F.R. Part 391. Carriers cannot claim ignorance, as the endorsement appears on a driver’s CDL, which the carrier is required to review, and its expiration date is clearly stated.
A vehicle transporting hazardous materials without required placards, with incorrect placards, or with damaged placards that are not legible has violated 49 C.F.R. Part 172, Subpart F. The carrier bears responsibility for ensuring compliance with the placarding requirements, and the driver bears an independent obligation to verify them before departure.

These requirements extend to reading shipping papers, understanding placarding requirements, and protecting themselves from exposure to hazardous material.
The FMCSA’s hazardous materials violations category is heavily weighted in the CSA Safety Measurement System.21 Violations in this category can trigger out-of-service orders, which remove the carrier and driver from operation immediately. Civil penalties for hazardous material violations under 49 CFR § 209.103 can reach $102,348 per day per violation under current figures, and up to $238,809 per day per violation when the violation results in death, serious illness, or severe injury.22
Criminal penalties operate independently of the civil regulatory framework. Under 49 U.S.C. §5124, a person knowingly, willfully, or recklessly violating federal hazmat transportation law faces up to five years in federal prison. If the violation causes the release of a hazardous material that results in death or bodily injury, the maximum sentence rises to ten years.23 These are federal criminal penalties that apply on top of any state charges arising from the same conduct.
The First Responder Consequence
The placard requirement exists to protect people beyond the parties to the crash. Firefighters, paramedics, law enforcement, and hazmat specialists who arrive at a crash scene make immediate decisions based on what the placards tell them.
A truck with no placards or incorrect placards presents a different kind of danger than an un-placarded standard freight truck. Emergency responders approaching a burning truck with no placards apply standard firefighting protocols. If that truck is actually carrying a poison inhalation hazard or a water-reactive material, the standard protocol can turn a rescue operation into a secondary casualty event.
Hazmat Status in Crash Litigation
When a crash involves a commercial truck hauling hazardous materials, the regulatory compliance record for both the driver and the carrier becomes central to the investigation. The endorsement file tells whether the driver was qualified to haul the load. The placarding record, evidenced by the shipping papers, bill of lading, and pre-trip inspection records, tells whether the vehicle was properly marked when it left the shipper’s facility.
Drivers who lack current hazmat endorsements are not authorized to operate vehicles in the configuration they were operating at the time of the crash. A carrier that verified nothing, dispatched without checking, or had no process for confirming endorsement status has a documented compliance failure that predates the crash by whatever time the driver had been hauling hazmat loads without authorization.
Placard violations carry a parallel analysis. Motor carriers are required to maintain a crash register that includes, at minimum, whether hazardous materials other than fuel were released. If a crash involves the release of hazardous materials, carriers must complete a hazardous incident report. The hazardous incident report documents what was released, when, and under what circumstances. These incident reports create a contemporaneous record of the crash’s hazmat component that is available to investigators in discovery.24
Carriers and drivers are required to maintain shipping papers that must describe the hazardous materials being transported, their quantity, and their hazard class. The shipping papers should identify what placards were required. Papers showing a Table 1 material requiring placards for any quantity, and yet the vehicle involved in the crash was un-placarded, indicate regulatory non-compliance.
FMCSA crash data tracks whether hazmat placards were present on large trucks involved in crashes by capturing this information from state crash reports at the scene. That data, maintained in the Motor Carrier Management Information System, is part of the carrier’s discoverable safety record. A carrier with a pattern of hazmat violations in its CSA data has a documented safety culture surrounding hazmat compliance that contextualizes the crash at issue.
