What Makes a Truck Oversize or Overweight

Weight limits on the Interstate System are established directly by Congress in federal statute. Under 23 U.S.C. § 127, commercial trucks operating on the interstate highway system may not exceed 80,000 pounds gross vehicle weight, 20,000 pounds on a single axle, or 34,000 pounds on a tandem axle.[1] Maximum width and length limits for commercial motor vehicles on the National Network are established under 49 U.S.C. §§ 31111-31113.[2] These statutory limits are distinct from FMCSA regulations: size and weight enforcement is administered by the Federal Highway Administration (FHWA), not the FMCSA.

The FMCSA governs motor carrier safety—driver qualifications, hours of service, cargo securement, and related operational requirements. The FHWA governs the physical dimensions and weight of vehicles on the highway network. The implementing regulations for size and weight are found at 23 C.F.R. Part 658, which gives operational effect to the statutory limits.[3] Both bodies of law apply to the same trucks, but they address different aspects of highway safety and are enforced through different federal programs.

Federal size regulations further establish additional limits: 102 inches (8.5 feet) maximum width, and trailer length limits that vary by configuration. There is no federal height limit; most states instead set their own maximum, commonly somewhere between 13.5 and 14 feet, and state limits vary and must be checked for each route.[4]

A truck or load that exceeds any of these limits is, by definition, oversize or overweight, and operating it without authorization is illegal. "Overweight" refers to loads exceeding weight thresholds; "oversize" refers to loads exceeding dimensional limits on height, width, or length. Loads can be both overweight and oversize.

Federal law recognizes, however, that certain legitimate cargo simply cannot be divided or reduced to fit within standard limits—a wind turbine blade, for example. For these non-divisible loads, states have authority to issue special permits allowing operation beyond standard limits.[5] The permit system is not a loophole. Operating outside the conditions of the permit is as illegal as operating without a permit at all.

The Permit System

When a carrier applies for an oversize or overweight permit, the issuing state engineers a controlled operation. Permits specify the exact approved route, travel time windows (often daylight only, with restrictions on weekends and holidays), required escort vehicles, and mandatory safety equipment, including "Oversize Load" banners, flashing amber lights, and flags.[6]

Route planning is the permit system's most critical safety function. An oversize load that clips a bridge with inadequate clearance, or an overweight truck that crosses a weight-restricted county road, can cause catastrophic infrastructure damage and fatal crashes. Permit-issuing agencies vet routes for low bridges, narrow corridors, weight-restricted roads, sharp curves, and utility conflicts. In Texas, the Texas Department of Motor Vehicles Motor Carrier Division issues single-trip and annual permits under Texas Transportation Code Chapter 623, and carriers operating under annual permits must still comply with route restrictions posted for specific hauls.[7] Critically, under Texas Transportation Code § 623.146, a permit is void upon the holder's failure to comply with a board rule or a condition placed on the permit, meaning that the moment a carrier deviates from a permit requirement, the authorization to operate that load on Texas roads is extinguished and further movement becomes an independent violation of the law regulating vehicle size and weight.[8]

Escort vehicle requirements exist to protect both the load and other drivers. A front escort warns oncoming traffic of an approaching wide load and checks clearances in advance. A rear escort protects against trailing vehicles closing on a slow-moving oversize haul. The number and positioning of escorts scale with the load's size: the wider or longer the load, the more escorts are typically required.

Speed restrictions are standard. An oversize load cannot safely execute the same maneuvers at highway speed that a standard truck can. Many permits set maximum operating speeds of 45 to 55 miles per hour, with further reductions required on curves or in construction zones. These are not advisory suggestions but conditions of the permit.

Oversized and Overweight Loads Are Inherently Risky

The permit system exists because oversize and overweight loads create hazards that standard trucks do not. Unlike a standard freight truck, an oversize or overweight load operates outside the physical parameters that the roadway infrastructure and other drivers were designed to accommodate.

  • Stopping Distances for Overweight Loads. Weight and stopping distance have a direct relationship. A fully loaded tractor-trailer at 80,000 pounds traveling 65 miles per hour requires approximately 525 feet to stop—nearly two football fields.[9] A truck operating over that weight needs even more distance. The brake system designed and rated for 80,000 pounds is now being asked to halt a heavier vehicle. On steep downgrades, where brakes already face thermal stress from sustained application, overweight loads accelerate brake fade and increase the risk of a runaway.
  • Vehicle Stability and Handling. Overweight loads alter the distribution of force across axles in ways that affect steering response and rollover resistance. Oversize loads, particularly tall ones, raise the center of gravity, narrowing the margin between stable and unstable in curves and emergency maneuvers. A wide load that encroaches into an adjacent lane forces other drivers to react to its presence at reduced margins, especially at night or in reduced visibility.
  • Clearance and Spatial Hazards. Oversize loads require precise route execution. A load that is 15 feet tall does not fit under a 14.5-foot bridge. Bridge strikes involving oversize loads have caused catastrophic structural failures and fatalities. But these strikes are not surprising; they are a predictable result of operating a load outside the route its permit specified, or operating without a permit at all.
PHYSICS OF A HEAVY HAUL

A Federal Case Study: The I-5 Skagit River Bridge Collapse

The consequences of failures in the oversize load permit system are not theoretical. On May 23, 2013, a truck-tractor operated by Mullen Trucking hauling an oversize load struck the I-5 bridge over the Skagit River near Mount Vernon, Washington. Contact damage to the bridge's truss structure caused one span to collapse into the river. Two passenger vehicles fell in, and three of the occupants involved suffered minor injuries; there were no fatalities.[10]

The NTSB investigated and determined that the probable cause was a strike to the bridge by an oversize combination vehicle that failed to travel in a lane with adequate overhead clearance, due to deficiencies in the interdependent system of safeguards for oversize load movements. The NTSB identified three contributing deficiencies: (1) insufficient route planning by the carrier and driver; (2) the pilot/escort vehicle driver's failure to perform required duties and to communicate potential hazards, due in part to distraction from cell phone use; and (3) inadequate evaluation of the oversize load permit request and no provision of low-clearance warning signs in advance of the bridge by the Washington State DOT.

Notably, the truck in this case had a permit for the route of travel. The failure was not the absence of a permit, but the failure of every party in the safety chain to perform the functions the permit system was designed to require. The NTSB issued 18 safety recommendations to federal and state agencies as a result of this investigation, addressing route evaluation, pilot car standards, and clearance signage requirements.

Where the System Breaks Down

The permit system works when every party with responsibility for the move takes that responsibility seriously. But the permit system fails in consistent, documented ways.

HOW THE SYSTEM FAILS
Operating Without a Permit
Carriers sometimes move loads that require permits without obtaining them. The motivations are usually time and cost: applications take time to process, permits cost money, and escort vehicles are an added operational expense. None of the safety functions occur: no route vetting, no clearance checks, no escort coordination. A non-permitted oversize load traveling an unvetted route is an uncontrolled hazard.
Violating Permit Conditions
A permit obtained but not followed provides no safety benefit. Common permit violations include deviating from the approved route, traveling outside permitted hours, failing to deploy required escorts, and operating without the required warning equipment. Each of these violations removes a specific safety control the permit was designed to provide.
Enforcement Gaps
Permit compliance is difficult to monitor in real time. For overweight loads, weigh stations catch weight violations when trucks stop, but weigh stations are often bypassed. Route compliance depends largely on carrier self-enforcement and the presence of law enforcement on the specific road being traveled. In practice, permit violations are often discovered only after a crash, when investigators pull permit records and compare them against GPS data and dispatch logs.

Investigating Permit Violations After a Crash

When a crash involves an oversize or overweight truck, investigators face a specific set of questions before they can establish what happened and who is responsible. The central question is whether the load was properly permitted and whether the carrier was operating within permit conditions at the time of the crash. Both require documentation—permit records are the baseline against which the truck's actual operation must be compared.

DOCUMENTARY EVIDENCE
The permit itself, bills of lading and load specifications showing cargo weight and dimensions, and dispatch instructions that may show the route the carrier intended regardless of what the permit authorized. Weight tickets from the origin facility establish what the truck weighed when it left; if the load was weighed at a weigh station en route, those records are also recoverable.
ELECTRONIC EVIDENCE
Often decisive. GPS and telematics data can show exactly where the truck traveled, at what speed, and at what times, and can be compared against the permit's approved route and time restrictions. Electronic Logging Device (ELD) data establishes when the driver was operating, which in permits with daylight-only restrictions can confirm whether travel occurred in an unauthorized window. A truck that deviated from its permitted route and then struck a bridge with inadequate clearance will leave a GPS record showing that deviation.
PHYSICAL AND SCENE EVIDENCE
Post-crash scale data to establish what the truck actually weighed, physical measurement of load dimensions, and damage patterns consistent with the nature of the violation: evidence of brake failure consistent with an overweight load on a downgrade, or impact damage consistent with a clearance strike on a route the permit did not authorize.
Prior inspection records in FMCSA's Safety Measurement System (SMS) can show whether the carrier had a documented history of size and weight violations, supporting the inference that the failure was not an isolated incident but a pattern of non-compliance.

Liability and Negligence Per Se

Operating without a required permit, or violating the conditions of one, is a statutory violation. In most jurisdictions, a statutory violation that causes the type of harm the law was designed to prevent establishes negligence per se.[11] Negligence per se means an injured plaintiff does not need to separately prove that the carrier's conduct was unreasonable—the violation of the statute is itself the evidence of unreasonableness.

The doctrine typically operates at the state level, not the federal level, and each state applies its own formulation of the basic principle: when a defendant violates a safety statute and that violation causes the type of harm the statute was designed to prevent, negligence is presumed. In Texas, for example, violating a condition of an oversize or overweight permit is a regulatory violation under Texas Transportation Code Chapter 623, and that violation can constitute negligence per se under Texas negligence law. Under § 623.146, a permit is voided upon a rule or condition violation, meaning the carrier's operation immediately becomes unlawful—and in a civil negligence claim, that fact carries significant weight. In states that do not formally apply negligence per se, a permit violation is still powerful evidence of a failure to exercise reasonable care, which is the core of any negligence claim.

Responsibility for permit compliance does not rest with any single party. The carrier that dispatched the truck bears primary liability for ensuring the load was permitted and that the driver was operating within permit conditions. The shipper bears responsibility where misrepresented load weights or dimensions prevented the carrier from obtaining the correct permit, or where the shipper pressured the carrier to move outside the permitted windows. The driver bears responsibility when they knowingly deviate from a route or operate outside permitted hours despite having the permit in hand.

In practice, liability in oversize and overweight cases involves multiple parties who each made decisions contributing to the crash. The documentary record of who obtained the permit, who planned the route, who issued the dispatch instruction, and who could have stopped the non-compliant move determines how that blame is properly allocated.

Why Permit Violations Persist

The economics of heavy haul create persistent pressure against compliance. Permit applications take time; escort vehicles cost money; daylight-only restrictions mean overnight moves aren't possible; approved routes may add significant miles. In a competitive, margin-thin industry, every one of these requirements is a cost, and the temptation to shortcut them is structural, not incidental.

Fragmented responsibility makes it worse. A shipper who needs a load moved by a deadline has an incentive to understate dimensions or pressure a carrier to skip the permit process. A carrier who relies on a third-party logistics broker may not fully understand the permit requirements for the specific cargo type. A driver who receives a dispatch instruction with a route may not know whether that route was permit-authorized. When no single party feels fully responsible for compliance, compliance tends to suffer.

The result is a permit system that works well on paper and inconsistently in practice. Crashes involving oversize or overweight loads are not inevitable. They are the predictable outcome of decisions made before the truck left the facility.
