Attorney Kurt Arnold

Kurt Arnold is one of the nation's most accomplished and skilled trial lawyers. During his legal career, he has fought tirelessly for justice for his clients and has an unmatched history of legal victories. Kurt cares about his clients' futures and co-founded Arnold & Itkin LLP at the age of 25 on the premise of providing exceptional legal representation to his hard-working clients.

Kurt believes that results matter. His track record proves it. Kurt's perseverance before a jury and reputation as a skillful and innovative negotiator have led him to winning more than $1 billion in verdicts and settlements in the last 5 years. Kurt's victories include numerous jury verdicts in excess of $10 million, more than 15 7-figure jury verdicts, numerous settlements in excess of $10 million, and hundreds of settlements in excess of $1 million. He obtained the record for the largest single-plaintiff personal injury verdict in the history of Louisiana ($117 million), the largest commercial verdict in the history of Hawaii ($42 million), and the largest verdict for an amputee in the country ($44 million). Kurt's efforts have also led to a nationwide recall of an unsafe, defective product.

In 2010, when the Deepwater Horizon exploded, killing 11 of its workers and injuring dozens more, 27 of the men and women on the rig at the time of the explosion (nearly one third of the crew) sought his help. Kurt represented more workers on the Deepwater Horizon than any other lawyer in the country, successfully resolved their cases, and ensured they would be taken care of for life.

As a result of his track record for aggressively obtaining huge verdicts and settlements, hundreds of lawyers and law firms across America have asked Kurt to try their cases. Kurt has also earned a reputation among his peers as the leading maritime and oilfield lawyer in the United States. It is due to this expertise that he is often featured in high-profile news sources that cover offshore and oilfield disasters, including a guest role on CNN's Anderson Cooper.

In 2013, he was named a Texas Super Lawyer at the age of 34 – one of the youngest lawyers in Texas history to achieve that honor; he was selected again in 2014. Previously, Texas Super Lawyer had recognized him as a Rising Star nearly every year of his practice. Kurt graduated from the University of Texas with High Honors at only 19 years of age. He then attended UT law school, graduating with Honors in the top 10 percent of his class. Kurt began his legal career working at a boutique Houston litigation firm before he co-founded Arnold & Itkin LLP at the age of 25. • $117 Million Verdict Won for Ambulance Accident Victim

Arnold & Itkin, LLP successfully tried a case on behalf of the victim of a severe ambulance accident. The plaintiff had been seven months pregnant and experiencing stomach pain when she called Acadian Ambulances to pick her up and transport her to the hospital in December 2010. The driver of the ambulance who picked her up had a history of bad driving and poor vision. When driving down LA-1 North, he dropped his RSI device onto the floor. Without reducing speed, he leaned down to locate and grab it – completely looking away from the road. During this time, he drove the ambulance into the back of a sugar cane truck. The plaintiff's spine was severed at T4 during the accident and she sustained serious brain injuries. There is no chance of a full recovery and she will be in a wheel chair for the rest of her life.

At the time of the verdict, she had already sustained medical bills in excess of $1.4 million, with an estimated cost of $30 million for her future care plan. After the accident, her unborn daughter was prematurely delivered; since then, both the infant and the plaintiff's other daughter have gone to live with their grandmother.

  • $44 Million Verdict Won for Man Injured in Crane Accident

Attorney Kurt Arnold represented a construction superintendent who sustained catastrophic injuries after a serious crane accident off Memorial Drive in Houston, TX. On the job, Berkel & Company had been hired to drill auger cast pilings. One of their crane operators had been operating a machine owned by Maxim Crane Works while completing deep foundation drilling when the auger became stuck; at that time, a Berkel superintendent instructed the crane operator to attempt to unstick the auger. The operator attempted to stop the job at least five times. The crane eventually collapsed.

At the time of the collapse, our client had been standing behind a safety fence approximately 100 feet from the auger when a piece of crane equipment struck him and pinned him down. It took a crane to lift the equipment off of him. He was then rushed to a hospital where an above-the-knee amputation was performed.

The trial took place over a three week period during which Kurt helped to show the jury that standard safety practices had been violated multiple times by Berkel in an attempt to finish the project quickly. Kurt also argued that Maxim was responsible for poorly inspecting the crane. The jury deliberated and found both companies to be negligent. They awarded damages for medical expenses, loss of earning capacity, physical impairment, physical pain, and mental anguish. They also awarded $8.5 million in punitive damages.

After the Court (Judge Sanderson, presiding) denied pretrial motions, plaintiffs set out to prove that the crossing was a unique and local safety hazard and that Union Pacific should have installed active warning devices at the crossing, which was only protected by street signs at the time of the accident. After presenting the jury with evidence that sight lines were deficient, the crossing’s orientation made it challenging to look to the left because the road approached the crossing at a thirty degree angle, and that there were four prior accidents, including two deaths, over the seven years prior to the accident, the jury found that the crossing was hazardous and that Union Pacific should have protected the crossing with active warning devices.
