Product Liability

Federal and Texas product liability laws hold manufacturers and distributors of products responsible for injury or death caused by the defective product. While product liability defendants can be held liable for their negligence, products liability claims are ordinarily based on strict liability. Rather than focus on the behavior of the manufacturer, strict liability claims focus on the product itself. Under strict liability, the manufacturer is liable if the product is defective, even if the manufacturer was not negligent in making the product defective.

Improperly designed seat belts can cause the buckle to unlatch during an accident or rollover, the belt retractor to fail during an accident, or strangulation, neck and spinal injuries during an accident.
  • Air bag defects: Not all air bags serve to protect drivers and passengers. When airbags are defective, they can cause chemical burns, severe head injuries, eye damage or even death.
  • Silicosis: Silicosis is caused by exposure to silica. Inhalation of silica dust can scar and inflame the lung and even cause death.
