Toll transponder records are fixed-point electronic records. They do not show a truck's entire route the way GPS or telematics data can, but they can show that a transponder, account, license plate, or vehicle class was detected at a known tolling point at a recorded time. In a truck crash investigation, that kind of record can be valuable because it comes from a third-party tolling system rather than the motor carrier's own files.
Modern toll evidence is broader than the old idea of a paper tollbooth receipt. Many toll systems now use transponders, toll-by-plate imaging, open-road gantries, license plate recognition, electronic invoices, and account statements. The Pennsylvania Turnpike's electronic toll collection guidance states that toll information may include account-holder information, transponder information, vehicle registration, time, date, location of entering and exiting the Turnpike, toll charges, vehicle class, and, in some instances, an image of the vehicle.¹
That structure makes toll data useful for timeline reconstruction. A toll transaction can establish that a truck passed a specific interchange, plaza, toll point, or gantry at a specific time.
If the crash happened later, investigators can compare the toll time to the driver's:
Toll records are not perfect. A transponder may be used in multiple vehicles. A toll agency may not retain images when a valid transponder is read. Some records may show account activity without proving which exact vehicle carried the transponder unless the account, vehicle list, license plate, and other records are connected. The Pennsylvania Turnpike guidance warns that an E-ZPass transponder can be used in multiple vehicles and that the Commission cannot verify the specific vehicle in which a transponder was used based only on the transponder read.²
Those limitations do not make the records useless. They tell investigators what else must be requested: the account holder, vehicle list, transponder number, license plates, toll-by-plate images, invoices, vehicle class, transaction detail, and records showing whether the toll agency captured an image or only a valid tag read.
Why Toll Records Matter in Truck Crash Investigations
Toll data matters because it is independent. A carrier's logbook, dispatch record, or route sheet may be incomplete, inaccurate, or created after the fact. A toll transaction is created by a separate system whose purpose is billing, not defending litigation. That makes it especially useful when the question is where the truck was and when it was moving.
Federal hours-of-service rules already recognize the value of supporting documents. Under 49 C.F.R. § 395.8, drivers must keep records of duty status current, certify their records as true and correct, and motor carriers must retain records of duty status and supporting documents for at least six months.³
FMCSA's supporting-document guidance is even more direct. It lists supporting-document categories such as:
For drivers using paper records of duty status, FMCSA specifically states that motor carriers must also retain toll receipts, and that toll receipts do not count against the ordinary eight-document cap for paper-log supporting documents.⁴
How Toll Receipts Can Be Used in Real-Life Cases
The D.C. Circuit's decision in Darrell Andrews Trucking, Inc. v. FMCSA is the central litigation source. The court upheld FMCSA's treatment of toll receipts as supporting documents because they could be used by the carrier and agency investigators to check the accuracy of drivers' records of duty status. The court noted that toll receipts are normally date- and time-stamped and can be used to verify compliance with maximum-hours rules.⁵
That case also shows why organization matters. The issue was not just whether toll receipts existed. It was whether they were maintained in a way that allowed them to be matched to individual drivers. The court discussed FMCSA's concern that combining receipts or removing them from trip envelopes could make it impossible to correlate toll records with a particular driver's log.⁶
Similarly, a second federal appellate decision, A.D. Transport Express, Inc. v. FMCSA, involved FMCSA enforcement related to toll receipts and driver log verification. The Sixth Circuit upheld an FMCSA order after the agency found record-keeping violations and required drivers to submit toll receipts so the carrier could verify records of duty status for accuracy.⁷
How Toll Data Tests Logbooks & Travel Time
The simplest use of toll records is comparison. If a driver's log says the driver was off duty, in a sleeper berth, or stopped in one location, a toll transaction may show that the truck passed through a tolling point during that same period. If the log says the driver began moving at 8:00 a.m., but the toll transaction shows the vehicle crossed a gantry 150 miles away at 8:15 a.m., the records cannot both be accurate.
Toll records can also establish travel windows. A toll transaction at Point A at 10:02 p.m. and another at Point B at 11:12 p.m. show that the vehicle traveled between those fixed points during that interval. If investigators know the distance between the tolling points, they can calculate minimum average speed. That calculation is not the same as ECM speed, GPS speed, or radar speed. It is an elapsed-time average across a known segment. But it can still expose impossible logs, unrealistic trip times, or evidence that a driver was traveling faster than claimed.
This is particularly useful when other electronic data is missing. A carrier may not preserve GPS records. ECM data may be overwritten. A driver may not have a dash camera. But toll records may remain with a toll authority, a toll account administrator, a fleet payment platform, or a third-party billing processor. Investigators should treat the math carefully. Average speed depends on accurate toll locations, accurate timestamps, time-zone consistency, correct vehicle identification, and a known route between points. If a truck could have exited, stopped, or taken an alternate route, the calculation must account for those possibilities. But where the toll points are sequential on a limited-access roadway, the records can provide strong evidence of movement and timing.
Toll data can also corroborate non-toll records. It can match:
- Fuel receipts
- Weigh station records
- ELD location events
- Dispatch messages
- Gate-entry records
- Bills of lading
- Loading appointments
- Hotel records
- Phone records
The best use is usually not one toll record in isolation. It is a timeline built from independent sources.
PrePass & Weigh-Station Transponder Records
PrePass and weigh-station bypass systems create a related but distinct category of evidence. Toll systems record transactions for payment. Weigh-station bypass systems electronically screen commercial vehicles for safety, credentials, weight, and inspection decisions. FMCSA's transponder-based weigh station technology report explains that e-screening systems identify commercial motor vehicles while they are moving and approaching fixed weigh or inspection stations. The systems check credentials, size-and-weight information, and carrier safety information, then communicate whether the driver should pull in or bypass.⁸
Washington State DOT describes the same concept in similar terms, explaining that electronic screening lets compliant carriers skip the physical stop by verifying vehicle weight, safety status, and violations electronically as the vehicle continues past the site.⁹
PrePass describes its transponder system as allowing trucks to bypass weigh stations by electronically verifying legal weight, safety rating, and credentials at highway speed; the driver receives a green light to bypass or a red light to report to the station.¹⁰ But PrePass data should not be overstated. PrePass states in its FAQ that the app displays only the date and not a timestamp, and that location is identified only for weigh-station bypassing and safety alerts.¹¹ That means PrePass or weigh-station records may help show that a truck approached a screening location, received a bypass decision, or was operating in a corridor, but the available data depends on the system, account, retention settings, and agency records.
The practical lesson is to request both categories separately. Toll transponder records may show payment transactions. Weigh-station bypass records may show screening events. Each can support or contradict the other, but they are not interchangeable.
How Toll Records Are Obtained
Toll records may be obtained through party discovery, subpoena, public-information procedures, court order, or law-enforcement process depending on the toll authority, jurisdiction, and type of information sought. The path matters because toll data often contains protected account and location information.
E-ZPass Virginia's privacy policy states that E-ZPass and violation information may be disclosed as required by law or pursuant to court order, subpoena, or other legal process, and that subpoenas and court orders are reviewed before information is provided.¹² New York's E-ZPass account information policy is more restrictive for civil matters. It states that account information will not be released in response to civil subpoenas unless directly ordered by a court of competent jurisdiction.¹³
The Pennsylvania Turnpike guidance provides a useful example of how specific requests must be. It states that requests should identify the type of records sought, the time frame, the registration, the transponder number, tolling point, direction of travel, vehicle class, and whether the requester seeks images, E-ZPass customer data, or both.¹⁴ It also warns that toll information is protected from unauthorized disclosure, is not designed for identification or surveillance purposes, and cannot be provided through ordinary public-records requests or civil subpoenas in some circumstances. That warning is important. Toll records may be obtainable, but the request has to be properly directed and legally supported.¹⁵
Texas toll systems add another layer: since November 9, 2024, toll-transaction processing for TxDOT's toll roads in the Austin and Houston regions has been handled by the Harris County Toll Road Authority rather than TxDOT directly.¹⁶ HCTRA's toll-violation search page notes that toll amounts are typically available within 7 to 10 business days of a trip, while out-of-state license plate transactions may take up to 30 days to post online.¹⁷ TxDOT's public-information page states that Texas Public Information Act requests must be made in writing and must include a clear description of the records sought.¹⁸
NTTA maintains a formal channel—its Public Information Act Center—for processing requests for records, including subpoenas and Public Information Act requests.¹⁹ For Texas crash investigations, that kind of formal channel matters because toll records obtained through litigation may need to be properly authenticated before they are admitted as evidence.
Discovery Requests Must Be Specific
Toll records are electronically stored information. Federal Rule of Civil Procedure 34 allows parties to request electronically stored information and to specify the form in which it should be produced. Rule 34 requires a responding party to state the form it intends to use if none was specified in the request, and directs that, absent agreement, the information be produced in the form in which it is ordinarily maintained or in a reasonably usable form.²⁰
Texas Rule of Civil Procedure 196.4 similarly requires a party seeking electronic or magnetic data to specifically request it and specify the form in which it should be produced.²¹ A request that simply asks for “toll records” may produce a PDF invoice, when the more useful evidence is a transaction export with fields for date, time, tolling point, transponder, plate, class, amount, and account.
A complete request should seek:
The records should be requested in native or reasonably usable electronic form when possible. A screenshot or billing summary may omit important database fields. A CSV, Excel file, data export, or custodian-certified transaction report may preserve the information needed to calculate travel time and match records to a truck, driver, route, or account.
Toll Record Preservation & Timeline Reconstruction
Toll transponder evidence should be requested early. Federal guidance states that motor carriers must retain records of duty status and supporting documents for six months.²² That six-month window means toll receipts, trip records, and supporting documents may be retained by the carrier only for a limited period, while toll agencies and account administrators may have their own retention schedules.
A preservation request should go to the carrier, driver, toll account holder, toll authority, fleet-management vendor, and any third-party billing administrator known to handle toll payments. It should identify the truck, trailer, driver, license plates, transponder numbers, toll accounts, date range, route corridor, and crash window. Where the transponder number is unknown, the request should include known plates, vehicle description, vehicle class, toll points, and time range.
Toll data is strongest when it is placed into a larger chronology. The timeline may start with dispatch instructions, loading time, ELD duty status, and fuel purchases. Toll records then establish fixed points along the route. Weigh-station bypass records may add additional screening points. GPS, ECM, cell phone, dash camera, and bill-of-lading records can fill the gaps. The result can confirm the driver's account or disprove it. It can show that a driver was moving during claimed off-duty time, that a trip could not have been made without speeding or falsifying logs, that a truck used a particular route, or that a carrier's internal records omitted part of the trip.
Toll Records Are One Piece of a Larger Picture
Toll records do not replace crash reconstruction. They do not show braking, steering, lane position, distraction, or impact speed at the crash scene. Their value is narrower and often decisive. This being a fixed location, a recorded time, an account or vehicle identifier, and an independent system that may be harder to dispute than a carrier-created log. In trucking litigation, that is often enough to turn a disputed story into a documented timeline.
