Unsafe Lane Changes

An unsafe lane change is not simply a vehicle moving from one lane to another. In commercial trucking, it is often a recognition failure. The driver must know where nearby vehicles are, where blind spots begin, how fast traffic is moving, whether there is enough space to merge, and whether a signal has given surrounding drivers enough time to react. FMCSA describes unsafe driving by commercial motor vehicle operators as dangerous or careless operation, including speeding, reckless driving, improper lane change, and lack of attention. FMCSA also identifies unsafe driving as a leading factor in crashes, injuries, and fatalities involving commercial motor vehicles.¹

The most useful federal framing is inadequate surveillance. FMCSA defines inadequate surveillance as a situation where a driver is required to look to safely complete a maneuver but either fails to look in the right place or looks and does not see. FMCSA gives lane changes and intersection turns as examples. The Large Truck Crash Causation Study reported that 14 percent of large truck crashes occurred because of commercial motor vehicle drivers' inadequate surveillance. That statistic should not be overstated as proving that lane changes alone caused 14 percent of large truck crashes. It is broader than that. It includes failures to see surrounding traffic during maneuvers such as lane changes, turns, and merges.²

Lane changes also fail when drivers misjudge the behavior of other vehicles. FMCSA reports that 75 percent of lane change and merge crashes involve a recognition failure by the lane changing or merging driver. In more than 90 percent of those crashes, the lane changing or merging driver was operating a passenger vehicle, not a truck. That detail matters because truck drivers must account for other motorists' errors as well as their own. A safe lane change requires more than checking a mirror once. It requires continuous awareness of traffic that may be hidden, closing quickly, or moving unpredictably.³

The Blind Spot Problem Is Structural

Large trucks have large blind spots around the front, rear, and sides of the vehicle. FMCSA's public guidance for motorists explains that large trucks and buses have operating limitations such as large blind spots, long stopping distances, and limited maneuverability. It warns that if a motorist cannot see the driver in the truck's side mirror, the driver likely cannot see the motorist. It also warns that cutting in too close can place a vehicle in a blind spot or leave the truck unable to slow quickly enough to avoid a crash.

The blind spot problem does not excuse unsafe lane changes. It explains why professional drivers are trained to account for them. FMCSA tells truck and bus drivers to check mirrors every 8 to 10 seconds so they remain aware of vehicles entering blind spots. It also tells them to scan about 15 seconds ahead, which equals about a quarter mile on an interstate, for traffic problems, work zones, and other hazards.

The CDL manual gives a more detailed lane change procedure. It tells drivers to:

Those instructions describe a process, not a formality. A truck driver who signals and moves immediately may still make an unsafe lane change if the signal did not give traffic time to respond. A driver who checks one mirror but fails to monitor convex mirrors, blind spots, and closing traffic may still miss a vehicle beside the trailer. A driver who changes lanes abruptly may create risk even if the truck never fully crosses the lane line before contact. The question is whether the driver used the information available before moving a vehicle that may be more than 70 feet long into occupied traffic.

What Crash Data Shows

Federal crash data does not treat every lane change the same way. A lane change crash may involve an intentional lane change, a merge, a pass, a drift, a turn across another vehicle's path, or a vehicle leaving a parked position. NHTSA's analysis of lane change crashes defined the category as two vehicle crashes in which one vehicle encroaches into the path of another vehicle traveling in the same direction on a parallel path. Using 1999 crash data, NHTSA estimated 539,000 two vehicle lane change crashes, about 9 percent of all police reported motor vehicle crashes that year.

That NHTSA report also separated lane change crashes into seven common precrash scenarios. The largest category involved two vehicles traveling on parallel paths, with one vehicle intentionally changing lanes and colliding with the other. That scenario accounted for an estimated 207,000 crashes. The report found that the seven most common scenarios accounted for about 88 percent of two vehicle lane change crashes. It also found that 10 percent of typical lane change crashes involved large trucks changing lanes while light vehicles continued straight, while the highest truck involvement appeared in the merging scenario, where trucks accounted for 42 percent of those crashes.

Large truck data also shows how often same direction sideswipes appear in reported crashes. FMCSA's 2020 table for large trucks in crashes by manner of collision listed 173 fatal crash involvements, 18,000 injury crash involvements, and 92,000 property damage only crash involvements for same direction sideswipes. Same direction sideswipes represented 16.4 percent of large trucks in injury crashes and 28.2 percent of large trucks in property damage only crashes.

Those numbers do not prove that every same direction sideswipe began with an unsafe lane change. Some may involve drifting, merging, passing, avoidance maneuvers, or other roadway events. But they show that side to side contact in the same direction is a common large truck crash pattern. When a tractor trailer sideswipes a smaller vehicle, the danger may not be limited to the initial scrape. The struck vehicle may be pushed toward a barrier, forced into another lane, spun sideways, or placed into the path of surrounding traffic. In dense traffic, one unsafe lane change can turn into multiple impacts.

Lane Departure Research Points to Surveillance, Speed & Distraction

The Large Truck Crash Causation Study is useful because it does not reduce crashes to one label. FMCSA explains that researchers collected detailed information on crash events, drivers, vehicles, the environment, and the crash scene. The coding began with the critical event, the critical reason for that event, and associated factors. FMCSA also explains that the critical reason is not a legal fault assignment. It is the immediate reason for the critical event, and it works with associated factors to explain the full range of risk events that produced the crash.¹⁰

A lane departure study using LTCCS data provides more specific detail. Researchers found that for large truck drivers determined to be responsible in multi vehicle lane departure crashes, the most common critical reasons included:

Misjudging a gap or another vehicle's speed also appeared as a listed critical reason.¹¹

That research supports a practical point about unsafe lane changes. They rarely arise from mirror use alone. A lane change can become unsafe because the driver is hurrying, traveling too fast for conditions, distracted by events inside or outside the cab, using mirrors incorrectly, or misjudging the speed of a vehicle approaching from behind. A truck driver may look and still fail to perceive the risk. A driver may perceive the other vehicle but incorrectly assume there is enough space. The crash record often must determine which failure occurred.

FMCSA's general LTCCS analysis brief reaches the same kind of conclusion. It explains that large truck crashes were analyzed through critical events, critical reasons, and associated factors. Driver related critical reasons included recognition errors, decision errors, and performance errors. Recognition errors include inattention, distraction, and inadequate surveillance. Decision errors include traveling too fast for conditions, following too closely, and misjudging another vehicle's speed.¹²

Federal Rules Treat Improper Lane Changes as Serious

Federal safety materials do not treat improper lane changes as minor mistakes.

The commercial driver licensing rules go further. Under 49 C.F.R. § 383.51, making improper or erratic traffic lane changes is a serious traffic violation. A second conviction for any combination of serious traffic violations within a three-year period can disqualify a CDL holder from operating a commercial motor vehicle for 60 days. A third or later conviction can result in a 120-day disqualification. The same table includes excessive speeding, reckless driving, following too closely, and certain traffic control violations connected with fatal crashes.¹⁴

FMCSA's Safety Planner summarizes the same framework, identifying improper or erratic lane changes as a serious offense that can require a minimum 60-day disqualification.¹⁵ This matters in carrier investigations. A prior improper lane change citation can be more than a line on a motor vehicle record. It may show a pattern of unsafe driving, especially when combined with prior speeding, following too closely, preventable sideswipes, mirror related discipline, or dashcam events. A carrier evaluating a driver's safety history should not treat lane change violations as harmless simply because they did not involve a fatal crash.

Technology Can Help, But It Does Not Replace Driver Judgment

Blind spot detection and lane departure warning systems are designed for the exact failure points that appear in lane change crashes. IIHS has reported that blind spot detection reduces the rate of all lane change crashes by 14 percent and the rate of injury lane change crashes by 23 percent in passenger vehicles. IIHS explained that blind spot detection provides a visual alert when an adjacent vehicle is in the driver's blind spot, but the driver still must pay attention to the warning and use it correctly.¹⁶

For large trucks, IIHS has estimated that crash avoidance technologies could have a substantial effect. IIHS reports that the combination of stability control, blind spot detection, forward collision warning or mitigation, and lane departure warning or prevention could prevent or mitigate as many as 107,000 police reported crashes each year, representing 28 percent of all crashes involving large trucks. It also states that blind spot detection has the greatest potential for preventing large truck crashes of any severity.¹⁷

IIHS has described side view assist for large trucks as a system that uses cameras or radar sensors to monitor areas alongside trucks and alert drivers to vehicles in blind spots. Among 97,000 annual large truck crashes involving intentional lane changes, IIHS reported that side view assist could prevent or mitigate nearly 39,000 crashes, including about 2,000 injury crashes and 79 fatal crashes.¹⁸

Technology evidence can be important after a crash. Investigators may seek:

  • Side sensor data
  • Lane departure alerts
  • Forward camera footage
  • Telematics data
  • Hard braking records
  • Turn signal data
  • GPS location
  • Safety platform records

But technology does not eliminate the driver's basic obligation to make a safe maneuver. It can warn. It can record. It can support coaching. It cannot make an unsafe gap safe.

How Unsafe Lane Changes Are Proved After a Crash

Unsafe lane change investigations focus on timing, position, and visibility. Dashcam footage can show whether the truck signaled, when it began moving, where the adjacent vehicle was, and whether surrounding traffic had time to react. Vehicle damage can show the direction of contact and whether the truck moved into the other vehicle or the other vehicle moved into the truck. Witness statements, 911 calls, roadway video, and nearby vehicle cameras can fill gaps when the truck's own camera footage is unavailable.

Litigation often turns on whether the evidence proves only a collision or also proves a broader safety failure. In Teal v. Crete Carrier Corporation, the plaintiff alleged that a tractor trailer driver made an unsafe lane change and struck her vehicle. The court dismissed claims for gross negligence and negligent hiring, entrustment, training, and supervision, noting that the record did not establish the heightened proof required for those theories. The opinion discussed evidence of prior moving violations and defensive driving training but held that the evidence did not show Crete's decision to hire the driver was negligent or that it proximately caused the plaintiff's injuries.¹⁹

Smith v. Tommy Roberts Trucking Co. illustrates the opposite type of evidentiary problem. There, the record included evidence of a driver's prior DUI, speeding tickets, a traffic control violation while operating a tractor trailer, an improper lane change citation after clipping another vehicle, a later speeding citation, and a following-too-closely charge. The Georgia Court of Appeals held that evidence regarding the employer's knowledge and failure to investigate the driver's record created issues for a jury on negligent entrustment, negligent hiring, and negligent retention theories.²⁰

The litigation lesson is practical. An unsafe lane change can be a single negligent act, or it can be one example of a known pattern. The difference depends on records.

The crash may happen in one lane movement, but the evidence often reaches back through hiring, training, monitoring, and prior warning signs.

A safe lane change by a commercial truck requires space, signal, surveillance, and patience. When one of those elements is missing, a side to side contact can become a chain reaction. The truck moves first. The smaller vehicle reacts second. By the time the crash is visible in the mirror, the opportunity to make the lane change safely may already be gone.
