Alexandria Catastrophic Injury Attorneys

Get the Answers You Deserve After a Life-Changing Accident or Injury

Catastrophic injuries are legally and medically defined as injuries that affect an individual's mobility or cognitive abilities long-term. In most cases, catastrophic injuries require victims to pay millions of dollars in medical expenses for life-long treatment and equipment. If you or a loved one have sustained catastrophic injuries because of another person's negligence, you may be able to receive compensation for your damages.

Arnold & Itkin is passionate about protecting the rights of people who have experienced life-altering injuries due to another's wrongdoing or negligence. Our Alexandria catastrophic injury attorneys have helped hundreds of people recover the compensation they rightfully deserve to help them secure their future. In total, our track record includes billions of dollars in verdicts and settlements, with hundreds of results of $1 million or more. Each of those results has helped a person pay for medical care, replace their lost earnings, and more.

Common Types of Catastrophic Injuries

Although there are different types of catastrophic injuries, almost all require life-long treatments that can be too costly for the average family. For example, victims who suffer an amputation or paralysis may have to pay for prosthetics and equipment to accommodate their injuries. People who suffer those injuries may also lose their careers, which means their only source of income will no longer be available to them.

Different types of catastrophic injuries include:

  • Acoustic Trauma & Hearing Loss: This type of injury can cause severe hearing disabilities that are life-changing. There is usually damage caused to the hearing mechanisms within the inner ear.
  • Blunt Force Trauma: This occurs when an object strikes a specific part of the body, often the head. This initial trauma develops into more specific types, such as contusions, abrasions, etc.
  • Brain Injuries: Trauma to the head or a lack of oxygen to the brain can cause permanent damage that affects a person's memory, cognitive skills, speech, personality, and ability to perform routine tasks.
  • Burns, Scarring & Disfigurement: A severe burn is characterized by the destruction of the skin through all skin layers and even into bone or muscle. This can lead to severe pain and disfigurement.
  • Neck & Back Injuries: These injuries can cause paralysis or other forms of lifelong disability.
  • Spinal Cord Injuries: A spinal cord injury causes permanent loss of strength, sensation, and function. At a minimum, this results in limb dysfunction. These usually require extensive medical treatment.

How Much Is My Catastrophic Injury Case Worth?

No two cases are the same, and the amount that a survivor recovers will vary. As Alexandria catastrophic injury lawyers, our goal is to find out what it will take to help survivors and their families recover. We push to hold the responsible party accountable, no matter what they try to avoid liability. We find answers for catastrophic injury survivors and help them get the best treatment and ongoing care to improve their quality of life.

Who Can Be Held Accountable for My Catastrophic Injury?

Catastrophic injuries may be caused by drunk drivers, manufacturers of defective products, careless job supervisors, or companies that ignore safety regulations. Because every case is different, your Alexandria catastrophic injury attorney needs to investigate your accident and determine what caused it and who should be held responsible. This is crucial for deciding how to get the medical and financial support you need.

Alexandria Spinal Cord Injury Lawyers

Spinal Cord Injuries & Their Consequences

When people suffer spinal cord injuries, their lives are completely upended. They and their loved ones are left facing tens or hundreds of thousands of dollars in medical bills and ongoing care, with no guarantee that they'll be able to earn a living like they used to. Then there's the emotional trauma of the accident and the acceptance that they'll be limited in certain areas and abilities.

The economic impact of a spinal cord injury is astounding. Not including lost earnings, a person living with a spinal cord injury may face the following in healthcare costs and living expenses:

  • For quadriplegia (paralysis from the neck down), the cost is over $1 million for the first year and over $184,000 for each subsequent year. The lifetime cost for a 25-year-old quadriplegic is more than $4.7 million. The lifetime cost for a 50-year-old quadriplegic is nearly $2.6 million.
  • For paraplegia (paralysis of the lower body), the cost is over $500,000 for the first year and about $70,000 for each subsequent year. The lifetime cost for a 25-year-old paraplegic is about $2.3 million. The lifetime cost for a 50-year-old paraplegic is more than $.1.5 million.
  • Incomplete motor function at any level may cost about $350,000 for the first year and over $40,000 for each subsequent year. The lifetime cost may range from $1.1 million to $1.5 million.

What Is the Most Common Spinal Cord Injury?

According to the Columbia University Department of Rehabilitation and Regenerative Medicine, the most common spinal cord injuries occur in the cervical and thoracic areas. The cervical area is located immediately below the skull and ends at the base of the neck. The thoracic spine starts at the base of the neck and extends to the back of the ribcage. A cervical injury may cause paralysis of the entire body (quadriplegia); depending on the location of a thoracic injury, it may cause paralysis of the legs and lower trunk (paraplegia) or both the arms and legs. The higher up on the spine the injury is, the more of the body it may affect.

How Do You Know That Your Spinal Cord Is Damaged?

The immediate signs of a spinal cord injury are:

  • Extreme pain or pressure in the neck, head, or back
  • Weakness, lack of coordination, or paralysis affecting any part of the body
  • A numb or tingling sensation in the hands, fingers, toes, or feet

If you suspect that someone has sustained a spinal cord injury, do not attempt to move them. Call 911 and wait for emergency personnel to arrive. They can properly immobilize the head, neck, and spine before transporting the person to the hospital. The only exception may be if the person's life is in peril if they remain where they are (submerged in water, near a fire or explosion, or similar scenario).

Alexandria Brain Injury Attorneys

Types of Brain Injuries & Their Causes

Some brain injuries occur due to congenital or hereditary disorders and cannot be prevented. Others happen during birth due to a lack of oxygen to the brain, sometimes because of medical malpractice or negligence. Yet others occur after birth in accidents. These are referred to as acquired brain injuries.

There are two primary types of acquired brain injuries:

  • Traumatic brain injuries are caused by an external force. A direct blow to the head or the sudden impact of a fall or car accident may cause a traumatic brain injury (TBI).
  • Non-traumatic brain injuries are caused by internal factors. A lack of oxygen to the brain or exposure to toxins may cause a non-traumatic brain injury.

People who have suffered brain injuries may face numerous challenges. They may have trouble remembering things, performing fine motor skills, thinking, speaking, and walking. Brain injury survivors and their families are often left with more questions than answers, wondering why it happened and who could be responsible.

Brain injuries may be caused by:

  • Traffic collisions, including motorcycle, car, truck, and pedestrian accidents
  • Defective or dangerous consumer products
  • Falls from heights and other construction accidents
  • Workplace accidents, including industrial accidents and plant accidents
  • Near-drowning accidents
  • Offshore and maritime accidents

Can a Person Fully Recover from a Brain Injury?

There is no straightforward answer to whether a brain injury survivor will fully recover. With mild brain injuries, recovery is possible. For example, with a concussion, most patients will recover most or all of their brain function within a month or so. With severe traumatic brain injuries, full recovery may be doubtful. Treatment for a moderate to severe traumatic brain injury may include neurosurgery, therapy, and psychological services. Even with a full range of treatment, a person with a serious brain injury may never fully recover.

Alexandria Wrongful Death Lawyers

Our Alexandria, LA Wrongful Death Law Firm Is Ready to Help You

When a family loses a loved one, they experience one of the most challenging situations they will ever face. Often, death and grieving can be made more difficult if the death was caused by the negligence of another person or entity. Wrongful death often causes the loss of income, lower quality of life, and emotional distress. Though these times may seem hopeless, it is essential to know that you have legal options. By contacting the experienced Alexandria wrongful death attorneys at Arnold & Itkin, you will be taking the first step to getting the help that you deserve. We know how difficult this time is—call us to find out how we can help you.

When to File a Wrongful Death Claim in Alexandria

Wrongful death occurs when the negligence of an individual or company causes a person's untimely death. When a person is killed, they often leave behind family members who relied on them for financial support. These family members can pursue at-fault parties for damages caused by the wrongful death of their relative.

Negligent parties must be held accountable for their actions—especially when they've caused the death of an innocent person. Even if those responsible for the death are already facing criminal charges, it is still possible to hold them accountable in civil court. If the responsible party is a corporation, they will only face punishment through a civil claim. A wrongful death claim is like a personal injury claim, except wrongful death claims are filed for the damages caused by a person's death, not for the damages caused by injuries.

Alexandria Wrongful Death Laws

Louisiana defines wrongful death as anytime a "person dies due to the fault of another." A responsible party may be sued for compensation in a wrongful death case, whether the death is caused by negligence, recklessness, or willful action. In Louisiana, family members have up to one year from the date of the death to file a wrongful death claim. However, only certain family members can make a claim.

The following people can make a wrongful death claim:

  • Spouse
  • Child
  • Parent
  • Sibling
  • Grandparent
  • Executor of estate

Notably, spouses and children are given priority in a wrongful death case. If the decedent has no children or spouses, the ability to make a claim transfers to parents, siblings, or grandparents. If an individual does not have family members, the executor of their estate can pursue economic damages.

Common cases our Alexandria wrongful death attorneys handle include:

  • Work Accidents: When a person is killed on the job, the claim likely qualifies as wrongful death. Employers are required to protect their employees with a safe work environment, proper equipment, and adequate training. If an employer's negligence causes the death of a worker, then the worker's family should be compensated for the loss of their loved one.
  • Motor Vehicle Accidents: All drivers are expected to operate their vehicles safely, with care for the safety of others. If a person runs a red light and kills someone, the decedent's family should receive just financial compensation. If a company manufactures a faulty car part that causes a deadly accident, this company should be held accountable for what it did.

What Can Be Claimed in a Wrongful Death Case?

Louisiana is like other states regarding what it allows to be claimed by family members of a person who has been wrongfully killed. These damages are split into two categories: economic and noneconomic losses.

Economic wrongful death losses include the following:

  • Funeral expenses
  • Medical bills incurred while the individual was receiving emergency treatment
  • Lost wages and benefits that the individual would have made if still alive
  • Services that the individual would have provided

Noneconomic wrongful death losses include the following:

  • Emotional suffering of family members
  • Pain and suffering experienced by the decedent before their passing

Does Louisiana Place a Time Limit on Wrongful Death Claims?

Those able to make a wrongful death claim must remember that Louisiana puts a time limit on the ability to file a claim. This means that action must be taken quickly to recover the losses that happen after a family member passes away due to the actions of another person. Though these times are difficult, it is critical to contact our experienced Alexandria wrongful death attorneys as soon as possible for assistance.

Alexandria Car Accident Attorneys

Our Motor Vehicle Accident Lawyers Have Won Billions

According to the National Highway Traffic Safety Administration (NHTSA), 2 out of 3 motorists will be involved in a car accident in their lifetime. The Center for Analytics & Research in Transportation Safety (CARTS), previously known as the Highway Safety Research Group, stated that there were 1,688 injuries from car accidents per 100,000 people in the state of Louisiana in 2023.

Cars aren't the only vehicles involved in accidents across Louisiana. We're committed to helping those impacted by these horrific crashes recover and fight for the justice that they deserve. From collisions that involve personal vehicles, such as car accidents and motorcycle accidents, to wrecks involving commercial vehicles, such as bus and truck accidents, our Alexandria motor vehicle accident lawyers have earned a reputation for being passionate, dedicated advocates. We also set the largest single-event personal injury verdict in the state of Louisiana, recovering a $117 million verdict on behalf of a young woman injured in an ambulance crash.

Common Causes of Alexandria Car Accidents

  • Aggressive Driving & Road Rage - A bad temper can lead to excessive risks on the road that endanger others. Aggressive driving can lead drivers to tailgate, change lanes excessively, and speed.
  • Defective Equipment - There are instances when drivers do everything right, but they still get hurt due to defective parts. A product liability claim could hold manufacturers accountable in these cases.
  • Drunk Driving - This is one of the country's leading causes of car accidents. Unfortunately, it is common for drunk drivers to doze off, lose focus, speed, drive erratically, or react slowly.
  • Tired Drivers - Studies show that fatigued drivers have similar performance behind the wheel as drunk drivers. Sleepy drivers have a slower reaction time, impaired judgment, and are likely to drift.
  • Dangerous Roadways - Roads can go neglected, especially in rural areas. Roads with potholes, roads with limited visibility, and roads without traffic signs can lead drivers to suffer serious accidents.

How to Recover from an Alexandria Car Accident

The first step you need to take to seek compensation is to contact an Alexandria car accident attorney. We can investigate your case to identify who is liable for the accident and the different legal options available to you.

Below are helpful questions to ask to determine who is at fault:

  • Could the accident have been prevented?
  • Was the other driver operating their vehicle under the influence of drugs or alcohol?
  • Was the other driver talking or texting on their cell phone?
  • Was the other driver faster than the posted speed limit or too fast for the weather conditions?

How Do Alexandria Car Accident Lawyers Help?

Our team is focused on helping clients recover. We'll look at all damages caused by your accident—from medical bills to lost wages—to ensure you have the financial security to move forward after your accident.

What If the Car Insurance Company Offered a Settlement?

Don't accept a car insurance settlement before speaking with a lawyer. Initial settlements might not include compensation for the full extent of your economic damages. Additionally, there's a chance that the insurance company is offering a lower amount than you deserve. Companies do this hoping that a person will accept as little as possible for a claim. Speaking with an Alexandria car accident lawyer is free of charge and will help you decide if a settlement is the best option for you.

What If Insurance Isn't Cooperating With My Claim?

Sometimes, insurance companies deny or delay valid claims hoping that claimants will become frustrated and give up or settle for less. Occasionally, these practices fall under something known as bad faith insurance. When a company is placing profits over their duty as a provider, hiring an Alexandria car accident attorney is the best way to show them these tactics won't be tolerated for your claim.

Alexandria Bus Accident Lawyers

Bus Accident Help for Passengers, Drivers, Cyclists & Pedestrians

Bus accidents can result in life-changing injuries because buses often lack the safety equipment almost any other vehicle is required to have. With many older buses still in operation, there is little guarantee of safety for passengers on commuter or charter buses, even as the driver is often in a seatbelt.

Bus accidents often result in catastrophic injuries like:

  • Burn injury
  • Brain injuries
  • Neck and back injuries
  • Post-traumatic stress disorder
  • Orthopedic injuries
  • Blunt force trauma

How Common Are Bus Accidents in Louisiana?

According to the Louisiana Crash Data Report, over 900 bus accidents were reported in Louisiana in 2018. Out of the 900 crashes, 486 were school bus accidents. Companies are responsible for keeping passengers safe, but more than 50% of the bus accidents reported were school bus accidents, and nearly 1 in 3 bus accidents is fatal.

The Dangers of Bus Accidents & Public Transportation

It is common for passengers, pedestrians, or other drivers to sustain severe injuries in a bus accident. In many cases, bus companies could have prevented injury if they had implemented adequate safety procedures to protect passengers. However, many bus companies are operating without the proper safety measures.

Common causes of bus accidents include:

  • Inadequately-trained drivers
  • Bus drivers under the influence
  • Improperly maintained buses
  • Negligent bus drivers
  • Lack of safety restraints
  • Speeding

Maintenance is one common issue that contributes to bus accidents. Companies fail to perform maintenance needed on buses to reduce costs. Mechanics are often pressured to repair buses quickly to get the bus back on the road, so companies fail to give mechanics the necessary time and space to fix major problems.

Alexandria Motorcycle Accident Attorneys

Our Louisiana Motorcycle Injury Lawyers Have Secured Billions for Clients

Many are attracted to the sense of freedom experienced by motorcycles. With just two wheels separating riders from the road, motorcycles have attracted legions of fans and riders. Unfortunately, the very things that many love about motorcycles are also the qualities with the most potential to cause harm. Their vehicles do not have the same safety features enjoyed by those who drive large automobiles and trucks. With no safety restraints or enclosures, motorcyclists may suffer injuries during even the most minor of accidents.

Motorcycle Accident Statistics

The National Highway Traffic Safety Administration collects data each year that explores the risks motorcyclists face on the road. These statistics reveal that, though motorcycles make up an extremely small minority of vehicles on the road, they are involved in a disproportionately high number of accidents. In fact, motorcyclists account for only 0.6% of the nation's total traveled miles but are 6 times more likely to be in an accident.

Causes of Alexandria Motorcycle Accidents

Most motorcycle accidents have similar causes. By understanding these causes, drivers of larger vehicles and motorcyclists will better understand which precautions to take to prevent accidents.

  • Left Turn Accidents: When motorists are yielding to make a left turn, they often fail to notice approaching motorcycles or misjudge the speed at which they are traveling. When a larger vehicle turns in front of a motorcycle, the impact is devastating for the motorcyclist.
  • Blind Spots: Motorcycles are small and easily hide in the blind spots of cars. When drivers are not observant, they may attempt a maneuver that places a motorcyclist they do not see at risk of collision.
  • Lane Splitting: Though lane splitting has not been made legal in Texas, many motorcyclists still practice it. Drivers should look for lane-splitting motorcyclists, whether it is legal or not.
  • Road Hazards: Cars can drive over road hazards with minimal danger. However, many obstacles are devastating to motorcyclists. These hazards include potholes, gravel, roadkill, water, snow, and ice.

When people need an advocate who has a track record of getting the best possible results, they call Arnold & Itkin. No matter what.

Facts About Work Accidents

The Occupational Safety and Health Administration was created in 1971 to reduce hazards in American workplaces. Because the economy was booming at the time, American workers were suffering an alarming rate of fatal injuries. Since 1971, OSHA has made significant progress in mitigating workplace hazards. However, employers still get away with harmful and unsafe practices. With only about 2,000 inspectors, millions of workplaces lack the accountability that would force them to maintain a safe work environment.

OSHA reported that 5,190 workers lost their lives in 2016. It is a frustrating reality that, if employers followed simple regulations, these deaths could be drastically reduced or eliminated. In an effort to encourage self-regulation, OSHA maintains a list of the most common violations it sees in American workplaces.

The most common OSHA citations include:

  • Fall protection
  • Hazard communication
  • Scaffolding
  • Respiratory protection
  • Control of hazardous energy
  • Ladders
  • Powered industrial trucks
  • Machinery and machine guarding
  • Fall protection training
  • Electrical hazards

Workers' Compensation & Work Injury Claims

In Louisiana, employers are required to carry no-fault workers' compensation insurance. This means that, regardless of who is at fault, a worker may make a claim if injured while at work or while performing their job duties. However, workers' compensation is not always adequate as it only provides a limited amount of relief. When accidents are severe enough to cause significant injuries, pursuing other sources of compensation is necessary. For example, suing a third-party contractor or manufacturer could allow you to get the money you need to pay for all your future treatment, which is typically required after a catastrophic work accident.

Benefits of a personal injury case include:

  • Obtain maximum medical relief by obtaining damages for current and future treatment
  • Compensation for any physical and mental pain and suffering caused by the employer's negligence
  • Compensation for a loss of the ability to make a living

Additionally, when employees hold their employer accountable, they help protect coworkers from future harm. When an employer is forced to answer for negligence, they are also forced to make the changes needed.

Alexandria Construction Accident Attorneys

Construction Accidents in Alexandria

Construction workers go to work daily, expecting employers to provide them with a safe work environment. In theory, every employer can and should provide these things. In practice, construction work is hazardous, leaving people with lifelong injuries after serious accidents. That's why OSHA regulates working conditions and requires employers to maintain the safest work environment possible.

The Alexandria construction accident lawyers at Arnold & Itkin LLP have won billions in verdicts and settlements helping injured people hold companies accountable. Our results include hundreds of results of $1 million or more, including a record-setting verdict for the victim of a crane accident at a construction site. Our firm understands why construction accidents happen and how much you'll need to recover from them. The first step is learning your legal and financial options in a free consultation, so call us as soon as possible.

The "Fatal Four" Construction Accidents

OSHA is responsible for compiling research annually to determine how safe work environments are nationwide. Their research shows that the construction industry has one of the highest workplace injury and fatality rates: about 1 in 5 workplace fatalities occurs on a construction site. Of those fatalities, OSHA has determined the four most common events that lead to fatalities in the construction injury. They call them the "Fatal Four."

The “Fatal Four” are:

  • Falls (38.7%)
  • Struck by Object (9.4%)
  • Electrocutions (8.3%)
  • Caught-in/between (7.3%)

These four types of accidents make up more than 60% of all construction accident deaths. OSHA classifies each of these four causes as 100% preventable with proper safety measures. If companies follow the required safety procedures, over 500 lives could be saved every year. That also means any loved one who dies due to the above list of accidents died due to employer negligence in some form or another.

Responsibilities of a Construction Employer

Ultimately, employers are responsible for workplace accidents, especially in high-risk environments. Employers must (1) maintain a workplace that reduces risks and (2) teach employees how to do their work safely. Insufficient staffing, training, or equipment creates the conditions that lead to tragic accidents.

Negligence may include the following:

  • Poor site designs
  • Insufficient inspections
  • Unmarked hazards, such as uncovered holes
  • Violating safety codes
  • Improperly secured equipment
  • The use of defective equipment

If a supervisor, employer, or equipment manufacturer inadvertently or directly causes an accident, they should be held liable for their negligence. Employee deaths and injuries will occur if employers fail to address these issues, so keeping them accountable is how we can keep construction workers safe.

Most Common Accidents & Causes of Injuries at Construction Sites

  • Scaffolding Accidents: These accidents are common when scaffolding is erected improperly, which makes it unreliable. Over 4,500 scaffolding accidents occur annually. More than 70% of workers said their injuries occurred because of a lack of support in the scaffolds.
  • Falling from a Height: OSHA's research shows that 660 fatalities occur annually because workers fall from a height. Construction workers must work on roofs, ladders, and scaffolding; if they lack the proper fall prevention equipment, their risk of injury goes up considerably.
  • Ladder & Stairway Accidents: Over 24,000 injuries occur every year in falling accidents. Workers fall from ladders or staircases; over 50% of workers had to take time off to recover from these injuries. Employers need to provide non-slip surfaces and handrails on all staircases whenever possible.
  • Defective & Dangerous Equipment: Employees should be trained on using complex machinery, and all equipment should be frequently maintained or immediately repaired when defective.
  • Harmful Chemicals & Toxic Exposure: Construction workers are often exposed to hazardous chemicals. Toxic chemicals can cause workers to suffer skin and throat irritation, corrosion, and more.

All About Alexandria, LA

Alexandria, Louisiana is located nearly on the exact center of the state on the south bank of the Red River. The city is the ninth largest in Louisiana and is the seat of Rapides Parish. As of the 2020 census, the population of Alexandria had reached 47,723. Alexandria has an elevation of just 75 feet and covers 27 square miles. The city receives rainfall and frequent thunderstorms throughout the year and is known for having a humid subtropical climate. Tropical storms and hurricanes can strike the Alexandria area, but usually without as much force and damage as they bring to cities closer to the Louisiana coast.

Alexandria was first settled in the late 1700s, after a businessman named Alexander Fulton received a land grant from Spain. Fulton then purchased more land from the Apalachee, Choctaw, Pascagoula, and Tensas tribes. In 1805, Fulton and a business partner laid out a plan for the town and named it in Fulton’s honor, though some people believe that the town was named after Fulton’s infant daughter, who passed away when the town was first plotted. Alexandria was incorporated in 1819 and received its city charter in 1832. The city grew quickly and became a center for trading, agriculture, and transportation because of its centralized location.

Today, Alexandria is recognized for its rich culture and history. Residents and tourists alike enjoy the area’s lakes and parks, museums, and historic sites as well as annual events like Mardi Gras, the Louisiana Dragon Boat Races, and the Alex River Fête. The Alexandria Museum of Art, Louisiana History Museum, Kent Plantation House, TREE House Children’s Museum, and the Alexandria Zoo are popular destinations. For those interested in catching a show, the Coughlin-Saunders Performing Arts Center and the Riverfront Amphitheater are top choices.
