Monroe Catastrophic Injury Attorneys

Fighting for the Seriously Injured in Ouachita Parish & Beyond

There is nothing more daunting than a catastrophic injury. These are injuries that completely alter the course of a person’s future—causing them to deal with debilitating medical expenses, often requiring a change in employment, and even requiring ongoing rehabilitation or around-the-clock medical care. From severe burns sustained in a plant explosion to a traumatic amputation, our Monroe injury lawyers have been there to help the survivors pick up the pieces. We understand how to take a comprehensive look at the associated costs of a serious injury so that we fight for compensation to cover current and past costs, as well as future expenses.

Examples of Catastrophic Injuries

  • Burn injuries require extensive medical care. Even after a person has recovered from their burn injuries as much as possible, they’re often forced to deal with the lasting repercussions of them. Scarring can inhibit movement and disfigurement can cause physical disabilities as long as lasting emotional trauma.
  • Blunt force trauma is an impact to the body that isn’t penetrating but causes a lasting impact. If blunt force trauma happens to the head, it can cause permanent brain damage.
  • Vision and hearing loss can be two of the most difficult types of injuries to heal from. They require a person to rediscover how they communicate and force them to adapt to new ways of interacting with the world around them.
  • Spinal cord injuries change a person’s ability to move. Depending on what part of the spine is injured, these injuries can cause full or partial paralysis. Besides being difficult physically for a person, they can be costly to obtain care for.
  • Neck and back injuries don’t always cause loss of movement. However, they can cause a person to live with permanent pain. Often, this pain prevents a person to have difficulties working as they did before their accident.

While just a few examples of catastrophic injuries, the challenges listed above show how many different types of accidents might be considered catastrophic. While serious, people suffering with these injuries can adjust their life to be as comfortable as possible. Doing this requires compensation—something that a Monroe, LA catastrophic injury lawyer from Arnold & Itkin can help fight for.

What Are Catastrophic Injuries?

A catastrophic injury is something that permanently inhibits a person’s physical or cognitive functions. Catastrophic injury doesn’t define a specific type of accident. Instead, it defines the characteristics that make multiple types of injuries very serious. If an injury has a lasting negative impact on a person’s life, it’s likely that it can be considered catastrophic.

What Compensation Is Possible After a Catastrophic Injury?

A catastrophic injury lawsuit can help a person obtain the financial security they need. A lawyer should work to help a person obtain the complete losses associated with their injury—included those that they haven’t experienced yet.

The following may be recovered from negligent parties:

  • Past and future medical care
  • Lost wages
  • Diminished future earnings
  • Psychological trauma
  • Pain and suffering
  • And more

When you call Arnold & Itkin, you’re turning a team that investigates all aspects of a person’s accident to make sure they can receive the compensation they need rather than the compensation they’re offered.

How Much Does It Cost to Hire a Catastrophic Injury Lawyer?

Hiring a catastrophic injury lawyer from our firm costs nothing upfront. Instead, we work on something called a contingency fee. We cover all costs associated with a case and only collect a payment if we win results. When hiring a lawyer, you need to make sure that you’re picking one that’s focused on results. Monroe, LA Wrongful Death Lawyers

When the Unthinkable Changes Everything, We Demand Answers

A wrongful death occurs any time the reckless behavior of one party causes the death of a person. A wrongful death can occur because of a company’s failure to provide a safe work environment or it can be triggered by the unsafe driving of an individual. In other words, the defining characteristic of a wrongful death is negligence.

When a person sustains serious injuries caused by third parties, they have an option that the deceased don’t have: filing a personal injury claim to recover damages. Wrongful death claims help make sure families can seek the retribution that their loved ones deserve. Additionally, it helps them obtain the financial security they need.

Wrongful death claims help families obtain compensation for things such as:

  • Lost wages
  • Loss of consortium
  • Funeral costs
  • Medical bills
  • Emotional suffering
  • And more

Incidents that Can Cause a Wrongful Death

The incidents that can cause a wrongful death are nearly limitless. However, there are several types of accidents that cause families to unexpectedly lose their loved ones.

Common causes of wrongful deaths include:

One of the most common types of Louisiana wrongful death claims involves work-related accidents. For example, if an employer fails to maintain equipment properly, it’s only a matter of time until that equipment causes a devastating accident. When these accidents kill workers, their families deserve compensation.

Car accidents are another common source of wrongful deaths. While many accidents involve negligent drivers who could’ve prevented an accident, they can also involve other factors. For example, some car accidents are caused by faulty car parts. When this happens, families can file a claim against the company that failed to make a safe product.

Who Can File a Wrongful Death Claim?

While losing a loved one is hard for anyone, the law limits who can file a wrongful death claim. Typically, the immediate family members of a person can file a wrongful death claim on their behalf.

The follow family members might be able to file a wrongful death claim for a loved one:

  • Parents
  • Spouses
  • Children
  • Siblings
  • Other dependents

Your ability to file a wrongful death claim depends on your situation. Calling Arnold & Itkin will help you discover what your options are at no cost.

What Is Recoverable with a Wrongful Death Claim?

Filing a wrongful death claim can help you recover three types of damages: economic, non-economic, and punitive. First, economic damages can be anything lost because of a person’s death. This includes their medical bills, lost wages, and the cost of their funeral. Non-economic damages include things that don’t have explicit value but are irreplaceable. These include the loss of an inheritance or the loss of a life partner. Finally, punitive damages are meant to punish the party that caused a wrongful death. These damages are important for punishing negligent parties while also making an example of them to prevent the same thing from happening to others.

How Much Is Hiring a Wrongful Death Lawyer?

Hiring a Monroe, LA wrongful death lawyer from Arnold & Itkin has not upfront costs. We work on something known as a contingency fee. This means that we cover all costs associated with a case and only collect a fee if we win results. Work Accident Facts

In 1971, the government created the Occupational Safety and Health Administration (OSHA) intending to protect American workers and reduce workplace dangers. The organization served as the government’s answer to inflated work-related fatality rates in the first half of the 20th century. Since its creation, OSHA has managed to decrease work accidents through the enforcement of safety regulations. However, many employers have taken advantage of OSHA’s limited number of worksite inspectors. With only a thousand or so OSHA inspectors in charge of over 8 million American workplaces, it is impossible for every employer to be held accountable for safety.

When employers cut corners with safety to increase profits, there are serious consequences. In 2016, OSHA reported that 5,190 workers were killed while performing their job duties.

To encourage employers to manage safety, OSHA maintains a list of the most common violations:

  • Fall protection
  • Hazard communication
  • Scaffolding
  • Respiratory protection
  • Control of hazardous energy
  • Ladders
  • Powered industrial trucks
  • Machinery and machine guarding
  • Fall protection training
  • Electrical hazards

Since knowledge regarding these hazards is made readily available by OSHA, employers that allow them to persist have no excuse for doing so. Employers have a responsibility to educate employees and provide the necessary safety equipment needed to make workplaces as safe as possible.

What Are the Most Common Workplace Accidents?

OSHA data shows us that construction accidents are the most common cause of workplace injury, but there are many other industries that are also dangerous for employees. The hazards are largely the result of employer negligence, which can happen in any work environment. Some common types of workplace accidents involve falls, scaffolding accidents, overexertion injuries, lifting accidents, and work-related motor vehicle accidents.

What Causes Workplace Injuries?

OSHA has found that workplace injuries are commonly caused by employer or coworker carelessness, inexperience, or negligence. Most accidents are preventable. Common causes include falling objects, flying debris, equipment failure, slips and falls, improper maintenance, inadequate inspections, insufficient training, and failures to comply with safety regulations.

What Are the Most Common Work Injuries?

Unfortunately, thousands of people lose their lives in workplace accidents every year. Even more are injured. Certain industries make you more susceptible to particular types of injuries, but there are commonalities across the board. Some of the most common work injuries include cuts and abrasions, back injuries, burns, sprains, strains, and overexertion injuries. When these injuries are catastrophic, they will affect a person’s life permanently and profoundly. When you’ve experienced this type of injury, you’ll want to have an experienced Monroe work injury lawyer fighting for the recovery you need for the rest of your life.

Work Accident Cases in Monroe, LA

In the state of Louisiana, employees can make workers’ compensation claims for any injuries they sustain while on the job. Every employer in Monroe is required to carry no-fault workers’ compensation insurance. The term “no-fault” entitles an employee to benefits regardless of who is at fault for the accident. The main requirement to receive a workers’ compensation settlement is for the injured party to have been working during their accident.

However, workers’ compensation is not always the best choice for those who have sustained serious injuries because of the negligence of their employer. Workers’ compensation only covers a certain amount of lost wages and medical bills, and it limits a person’s ability to recover other losses.

Choosing to pursue compensation through a personal injury claim enables workers to:

  • Obtain maximum medical relief by obtaining damages for current and future treatment.
  • Receive compensation for physical and mental pain and suffering caused by negligence.
  • Receive compensation for lost wages and lost future earnings.

Contact Leading Ouachita County Construction Injury Lawyers

Construction workers are a key part of the nation’s economy. Each day, employees in the construction industry face dangers from large machinery, falls from heights, and hazardous materials. When a worker is seriously injured or killed, it is most often the result of employer negligence. Employers have a responsibility to protect their workers by mitigating workplace risks. Unfortunately, many employers completely fail to invest in the safety training and equipment needed to prevent injuries and save lives.

Medical expenses, lost wages, pain, suffering and other hardships are difficulties that no one should face because their employer failed to protect their safety.

Construction’s Dangerous Record

Every year, the Occupational Safety & Health Administration (OSHA) collects data regarding fatal accidents in the American workplace. Since 1971, the organization has sought to decrease the number of harmful accidents in the workplace. Recent data from OSHA confirms that the construction industry accounts for 1 out of every 5 deaths in the private sector. Of the 4,693 worker deaths recorded by OSHA in 2016, 991 were individuals who died while working in construction. Construction accidents are so persistent that they receive special categorization.

OSHA has identified a group of common fatal hazards called the Fatal Four. These four causes of fatal accidents are the source of 63.7 percent of all deaths in the construction industry. OSHA focuses on these four deadly hazards for a reason—if they were eliminated, hundreds of lives would be saved every year.

Construction’s Fatal Four includes the following:

  • Falls (38.7%)
  • Struck by object (9.4%)
  • Electrocutions (8.3%)
  • Caught-in/between (7.3%)

What Steps Should I Take After a Construction Site Accident?

After an on-site injury, you’ll want to take certain steps to make sure your medical costs are well documented for the purposes of workers’ compensation. Too often, claims can be undervalued, delayed, or denied. Your actions immediately following your injury can help protect you from being unfairly compensated.

After a construction accident, you should:

  • Seek medical care. Your health is the most important thing, so you should see a doctor as soon as possible. Even if you do not think your injuries are serious, it is important to be evaluated. Some injuries may not be obvious at first.
  • Inform your site supervisor. In order to receive workers’ comp benefits, you must report the accident within 30 days. Failing to report the incident and your resulting injuries may lead to a claim denial.
  • Call an attorney. When it comes to Monroe construction accident claims, injured employees often find themselves facing denials, delays, and underpayments. Working with an experienced attorney can ensure you get what you need to recover and move forward.

How Can a Monroe Construction Accident Lawyer Help Me?

While we want to believe that companies will look out for their employees after construction accidents, that is rarely true. Some construction companies try to avoid responsibility and insurance providers do what they can to pay as little as they can—or nothing at all. In the meantime, injured workers are left hanging. An experienced attorney can make sure that your interests are being protected and that you receive the care you need.

Who Will Pay My Medical Bills aFter a Construction Accident?

If you were injured on the job, your employer should be responsible for the cost of your medical care. Workers’ compensation insurance is designed for this very purpose. When you file a claim, your medical care and a portion of your lost wages should be covered. If your employer doesn’t carry workers’ compensation insurance or your claim is denied, Arnold & Itkin LLP can help you fight for what you need to cover the cost of your medical bills, lost wages, and more.

About Monroe, LA

Monroe is the eighth-largest city in Louisiana and is the seat of Ouachita Parish. The city’s roots can be traced back to 1791, when the governor of the Spanish American provinces of Florida and Louisiana, Esteban Miro, had Fort Miro built in his name. When the first steamboat arrived in the spring of 1820, the outpost transitioned into a town and was renamed Monroe after the vessel, the James Monroe (named after the fifth President of the United States). Located in northeastern Louisiana, Monroe has an elevation of 72 feet above sea level and covers a total of 31.6 square miles. The U.S. Census Bureau estimates that the population of Monroe was 47,284 as of July 2021.

Today’s visitors to Monroe can learn about the area’s history at the Biedenharn Museum and Garden, which was built in 1913 as the residence of Joseph A. Biedenharn. He was the first bottler of Coca-Cola and one of the founders of Delta Air Lines (previously known as Delta Dusters). The Duck Commander offices and gift shop are also located in West Monroe and are a popular tourist attraction, thanks to the wildly successful A&E television show Duck Dynasty, which aired for 11 seasons and featured the Robertsons, the tight-knit Louisiana family that founded Duck Commander in the 1970s.

Some of Monroe’s other attractions include the 4,200-acre Black Bayou Lake National Wildlife Refuge, which offers a stunning setting where visitors can enjoy nature in peace, or the Chenault Aviation and Military Museum, which features over 11,00 artifacts from wars and the famous American aviator Claire Lee Chennault. The Northeast Louisiana Children’s Museum offers a fun and educational experience for kids of all ages, the Louisiana Purchase Gardens and Zoo features more than 500 animals from across the planet, and the Masur Museum of Art showcases unique visual arts attractions inside a historic Tudor-style home that was built back in 1914. There is plenty to enjoy indoors and outside in Monroe and West Monroe.
