Attorneys Noah Wexler and Ben Bireley recently filed a lawsuit against Kansas City Southern Railway Company arising from a fatal train collision between a locomotive and our clients’ passenger vehicle. Reports indicate that the train failed to properly utilize its horn before proceeding through the crossing at night, violently striking our clients’ vehicle and dragging it hundreds of feet down the tracks. The crossing did not have lights or guard rails.
The family’s mother was killed in the collision, and her son and sister were catastrophically injured. The death of a family member is naturally traumatic, but the death of a family member due to a brutal and preventable accident has lifelong ramifications. Add to that the injuries suffered by the victim’s son and sister, and the harm done by this accident is nearly incalculable. Kansas City Southern Railway is 100% culpable for this family’s loss, and they must be held responsible.
