Back in 2008, a Continental Airlines flight ran off of the runway at a Denver airport and caused many passengers to suffer gruesome injuries. About 60 of the individuals aboard the plane sued after the accident, and many targeted the Federal Aviation Administration rather than the airline and the pilot that were contributing factors in the crash. This is because the passengers claimed that air traffic controllers didn’t tell the pilot about the wind gusts that were prevalent on the runway before they gave him permission to take off.
While the air traffic controllers told the pilot the wind speeds, they did not inform him that gusts of wind at higher speeds and strengths were moving through the area and could affect his takeoff. The pilot of the plane also filed his own lawsuit against the FAA on these grounds, and said that he deserves to be compensated because the accident could have easily been avoided.
In all, after four years of deliberations the FAA has allegedly allowed millions of dollars to be given to the victims of the accident in a variety of settlements and verdicts. One report on KMGH-TV says that the accident settlements come up to several million dollars and the amounts range from under $100,000 for some who were aboard the plane to considerable larger amounts for those that were severely injured. The FAA referred all journalistic questions to the U.S. Department of Justice but neither party would offer additional information about the amount of money that was paid out to victims.
The national Transportation Safety Board claims that the air traffic control system and inadequate crosswind training by the air traffic control workers were in part responsible for the crash. Had the air traffic control workers known that there were crosswinds, then the Denver accident that caused so much sadness may have been avoided.
