Arnold & Itkin Attorneys Kurt Arnold, Caj Boatright, Roland Christensen, and Alison Baimbridge are currently representing the mother of a 23-year-old man who lost his life in a car accident. The man was overserved alcohol at a restaurant in Garland, Texas and allowed to leave the establishment when he shouldn't have.
The state has a law known as the Texas Dram Shop Law. This statute holds establishments liable for serving alcohol to individuals who are obviously intoxicated. We assert that the man was clearly drunk and that the restaurant continued to serve him alcohol regardless. Had the restaurant respected Texas laws, our client’s son would not have been overserved and he would likely still be alive today.
When businesses sell alcohol, they have a heightened responsibility to protect the safety of their patrons. No bar should be allowed to serve a person and then allow them to leave the building in an altered state of consciousness. Doing so places patrons and the public at risk of serious accidents. Arnold & Itkin will fight to obtain the justice that this woman and her son deserve.
