He was putting together a large metal barn at the instruction of the defendant when he fell from an unsafe walk board and tractor scaffolding device used to lift workers at construction projects.
The defendant, who owned the walk board and tractor, knew that the walk board did not contain the required pins used to secure it to the tractor forks. The board shifted suddenly as our client was working, throwing him from it. He fell 15 feet onto unpadded concrete, split open his head, and broke three vertebrae in his spine.
