Representing Lowe’s Customer Who Was Struck by Falling Lumber

Arnold & Itkin attorneys filed suit in Polk County, Texas against Lowe's after a customer suffered serious injuries when stacked lumber was knocked loose by a forklift and struck him inside the store. A trip to a home improvement retailer should not end in serious injury, and it would not have here if Lowe's had operated its equipment with the care its customers deserve.

A Lowe's forklift operator was moving materials in an unsafe manner when the forklift hit stacked lumber, causing the load to shift and strike our client. We expect the evidence to reveal that Lowe's failed to maintain safe operating procedures and failed to protect customers from the dangers created by heavy equipment operating in areas open to the public.

Running a forklift through the same aisles where customers are shopping is an inherently risky decision, and the only thing that makes it acceptable is strict adherence to safe operating practices. Lowe's fell short of those practices here, and the consequences fell on a customer who had no reason to expect heavy equipment to put him in danger.

Our premises liability attorneys are committed to holding Lowe's accountable for the unsafe conditions it created and for the serious harm caused to a paying customer who trusted the store to keep him safe.
