Helping Survivors of Catastrophic Injuries & Families Grieving a Wrongful Death
Per the CDC, drowning is the fifth leading cause of unintentional death in the U.S. with over 3,000 drowning victims every single year. Regardless of whether the drowning occurred at a pool, on a lake, or otherwise, it can leave individuals with questions that have no answers. Who was responsible? Could this have been prevented? What do we do now? If you are in a situation such as this, we want you to know you are not alone.
At Arnold & Itkin, we are here to help those impacted by drowning to fight for justice.
We understand what a harrowing event this can be, and we are here to step alongside you and provide the support that you truly need. By filing a lawsuit, we can help you shine a light on dangerous policies and procedures—not only to hold companies responsible for the role that they played in the tragedy but also to help prevent similar incidents from occurring again in the future. If you would like to know more about how our law firm can help in the wake of incidents such as this, we encourage you to contact us immediately.
Missouri Duck Boat Accident Results in Tragedy
In July 2018, a duck boat owned by Ride the Ducks, a nationwide tourism service, took a group of 31 people out into Table Rock Lake. The weather turned stormy—resulting in choppy water and winds up to 35 mph. The incident left 17 people dead and injured 7 more, several of whom were taken to hospitals in critical condition. While all boat accidents are dangerous, those that involve duck boats are particularly harrowing due to a canopy. Offering little protection, the canopy can trap passengers in the event of an accident. While the NTSB first recommended that duck boats remove the canopies nearly two decades ago, little has changed. Instead, thousands of individuals nationwide sign up for a tour aboard what looks like a fun vehicle not knowing they are putting their own lives at risk—and that the companies are doing nearly enough to prevent tragedy.
Determining Who Is at Fault in a Drowning Accident
Determining negligence can be complex in a drowning accident as there may be multiple parties that played a role in the incident. For example, if the accident occurred in a pool, it may because there was defective equipment (such as an incorrectly manufactured latch on a pool gate) or it may be because there wasn’t a lifeguard on a duty. If the drowning occurred following a boating accident, the company that operated the boat could be at fault. Because of this, it is critical that you talk to an experienced Missouri drowning lawyer who can help you answer your questions and investigate the case. This is not the time to entrust your future to the hands of a new lawyer. You need someone on your side who knows how to protect your rights and who is not afraid of a challenge. You need an attorney like Arnold & Itkin. Someone you can trust to fight for you.
