Construction Worker Burned at Circle K Buildout

Attorneys Noah Wexler, Trevor Courtney, and Shane Munton recently filed a lawsuit in Sioux Falls, South Dakota on behalf of a construction worker who suffered catastrophic burns while working a routine assignment at a local Circle K buildout.

Our client was directed by the contractors on site to dig a pit and then remove a component from a water pump. Nothing about that instruction should have put his safety at risk. Instead, the moment he removed the component, scalding water shot out and covered the lower half of his body, leaving him with second and third-degree burns.

Contractors have a duty to understand the equipment that they direct their workers to interact with, and they have a duty to ensure that the equipment is properly depressurized, shut down, or otherwise made safe before anyone is asked to touch it. That basic precaution appears to have been ignored here, and our client is the one who suffered the consequences in the most painful way possible.
